July 3rd marked the end of the 2011/2012 legislative cycle. What will be recorded in history as the shortest "short session" ever was marked with a number of accomplish-ments. Your conservative legislature, in spite of 19 vetoes by the governor, kept our promises to put NC back on the path toward financial prosperity, fiscal accountability, sound education reform and stronger private rights of our citizens. We passed a $20.2 billion budget adjustment, capped the gas tax, provided a 1.2% raise for teachers and state employees for the first time in over 4 years and restored education funding - all without raising taxes.

Relevant to our local District 3, we were able to secure a one-year moratorium on ferry tolls in order to study impact and look for alternatives to tolling. The budget adjustment also allocated $500,000 to help local communities protect our military bases from closure and restored a portion of funding for Tryon Palace. All of these successes were with bi-partisan support. Below are some key accomplishments in greater detail.

It has been an honor to serve you in the NC House, and I look forward to the opportunity to serve you in the NC Senate!

Fiscal Accomplishments

Balanced Budget: On July 2, 2012 Republicans in the House and Senate voted to override the Governor's veto of a $20.17 billion budget adjustment for 2012-2013 (HB 950). This bill fine-tuned some items from the previous budget. No tax rates were increased.

Regulatory Reform: SB 810 "Regulatory Reform Act of 2012" loosens regulatory requirements on citizens and businesses. Presented to Governor on 6/28/12.

Licensure: HB 799 will accelerate the process by which military personnel and their spouses can be licensed to lawfully practice their occupation once they have moved to NC. It allows the state Board of Education to issue teacher licenses to military spouses who are teachers in their home state. It was passed by the House and Senate on 7/2/12 and presented to the Governor.

Education

Funding: The 2012-2013 adjusted budget restores $251 million to public education. It provides $27 million for an education reform program that focuses on student literacy, improving graduation rates, and rewarding effective teachers. The budget fully funds enrollment growth in K-12, community colleges and the university system.

Raises: Teachers and all state employees were granted a 1.2% raise, the first in five years, and community colleges and the university system are given funds for a 1.2% raise for recruiting, retaining, or rewarding excellent instructors.

Policy: HB 7 allows community colleges to opt out of the William D. Ford Federal Director Loan program. The House and Senate overrode the Governor's veto on 6/18/2012 at the request of the Trustees of many community colleges.

Environment

Natural Gas: SB 820 "Clean Energy and Economic Security Act" creates the Mining and Energy Commission, which will develop regulations for horizontal drilling and hydraulic fracturing. Licenses will not be issued until further legislative action. It became law on 7/2/12 after the House and Senate voted to override the Governor's veto.

Property Rights

Protections: HB 925 requires that residents of an area have the opportunity to vote prior to that area being annexed by a municipality. It became law on 6/11/12.

Gun Rights

Protections: HB 843 repealed GS 14-288.7 which made it a Class 1 Misdemeanor to transport any dangerous weapon or substance in an area where there is a declared state of emergency. The act also prohibits municipalities and counties from restricting or prohibiting lawfully possessed firearms within a declared emergency area. It became law on 6/11/12.

Transportation

Gas Tax: The budget cuts and freezes the gas tax at 37.5 cents per gallon. This is 1.4 cents less than the current rate.

Ferry Tolls: After much behind the scenes work, the final budget language included a one-year moratorium on ferry tolls for the Cherry Branch-Minnesott ferry. A later technical correction also includes the Aurora - Pamlico River ferry. This will allow time to look at the impact of ferry tolling on citizens and study possible alternatives to ferry tolling.

Criminal Justice

Human Trafficking: SB 910 is a bipartisan bill that increases the penalties for the unlawful sale, surrender, or purchase of a child. This is a new tool to suppress human trafficking.

Murder: SB 105 increases the penalties for second degree murder and death by motor vehicle. It was presented to the Governor on 6/28/12.

Death Penalty: SB416 amends death penalty procedures. Major changes detail the use of evidence to prove racial discrimination. It eliminates the defendant's ability to use statewide statistical evidence. Statistical evidence alone is not enough to determine racial discrimination. It also limits the use of stat data to approximately a 15 year window around the time the death sentence was sought or imposed. It ends the moratorium on the death penalty. It became law on 7/2/12 after the House and Senate voted to override the Governor's veto.

Sanderson takes N.C. Senate District 2 primary

N.C. District 3 Rep. Norman Sanderson is one race closer to being N.C. District 3 Sen. Sanderson after winning more than 55 percent of the three-county vote in a three-way 2012 Republican Primary race for the seat.

Sanderson, of Arapahoe, led in Craven, Pamlico and Carteret counties against Randy Ramsey, a Beaufort businessman, and Ken Jones, mayor of Pine Knoll Shoals.

“My feet hurt,” Sanderson said, laughing after hard run he said ended up proving that “message over money” can be victorious. “I just think that we have the message and this victory shows that you can have all the money you want but that doesn’t always win.”

“I’m just amazed at the people in this district,” Sanderson said. “I had faith in them but when you’re bombarded every day with something that you want to scream out ‘it is totally not true,’ they were able to look through it and see the truth.”

Sanderson also had name recognition in the district as the incumbent Republican House District 3 representative who campaigned twice for that seat before this bid for the seat being vacated by Sen. Jean Preston, who is retiring at the end of this term.

His comments were directed at Ramsey, the owner of Jarrett Bay Boatworks in his first bid for public office, who challenged some of Sanderson’s positions in ads on radio, mail and television. Ramsey’s campaign got the attention of other state Republicans, the Associated Press and appeared on the Washington Post website.

What do Democrats Think About Randy Ramsey? 
TO THE EDITOR:

"As a life-long Democrat, former county party chair, and a current member of the North Carolina Democratic Party State Executive Committee, I thank Randy Ramsey for his donations to Democratic candidates and to the North Carolina Democratic Party.

His donations over the years have helped elect many fine Democrats, and his support of Bev Perdue is almost legendary in Democrat circles.

It does my heart good to see that Republican as he is and that Democrat as I am we can still support the same candidates and programs.

It is no small wonder that at a fundraiser for Gov. Perdue on the Friday of the Seafood Festival last October, held at the Morehead City Country Club, that Gov. Perdue made a point to recognize him and thank him for all his help over the years.

At one time there were many local Republicans that helped Bev Perdue, but by the time of that fundraiser most of them had abandoned her, but not Randy. He was there like he had always been since her days in the NC Senate.

As for the $7,500 he gave to the North Carolina Democratic Party in 2008, it was a Godsend. It helped us elect five members of the Council of State, a lieutenant governor, and the first woman in the history of North Carolina to the office of governor.

2008 was a hard fought election, but with the generous support of people like Randy Ramsey we were even able to carry North Carolina for President Obama.

I thank him again for his generosity, and if he is elected I hope that he will show the same kindness to the Democrats in the state Senate that are now in the minority.

Citing Gov. Bev Perdue’s widespread unpopularity, attorneys for Julia Leigh Sitton and Trawick “Buzzy” Stubbs — who played significant roles in Perdue’s 2008 campaign for governor — have filed motions asking for special treatment during the jury selection process in their upcoming trials. Since Ramsay has also played a significant role in Perdue’s campaign, when will he be indicted? Will he become the state senator and then sent off to jail? The real possibility of this should cause pause for all North Carolinians.

He gives vague, feel-good references to his intentions and preferences, but his record indicates otherwise. Norm Sanderson, on the other hand, has a record. On bills which had significant opposition, his record is: on delegate bills, he voted Republican 29 out of 32 times; on Senate bills, Republican 11 out of 12; on nine votes on vetoed bills, he voted all nine times to override.

We have seen more of the endless stream of slick mailers and now radio attack ads targeting Norm Sanderson. The strange thing is that these attacks only go to show that Ramsey is exactly what a number of us have been saying for weeks, that he is really a liberal just like the folks he has been supporting. The misinformation mailers say that Sanderson voted to implement Obama-care. Anyone who follows North Carolina politics knows this is pure bull as Sanderson co-sponsored the Health Care Freedom Act, which would have outlawed Obama-care in North Carolina. Unfortunately, Ramsey’s best political friend, Gov. Bev Perdue, vetoed it!

Our Senate race is again drawing statewide media attention as today's Carolina Journal Online Edition featured a top story about one of my campaign opponents, Randy Ramsey, and his suspicious campaign contributions. Campaign reports show that, despite scrutiny over Ramsey's association with Bev Perdue, there are three contributors to his campaign that were involved in the Easley/Perdue campaign scandals. One of these contributors was McQueen Campbell's wife who used her maiden name to fly under the radar. Another contribution came from Wendell Murphy of Clinton, NC, a major hog farmer who was subpoenaed in the Mike Easley investigation and also appeared with Ramsey on the unreported flights list for Perdue.

Read These Shocking Numbers

Sometimes in life you get "blindsided" - hit with something you never saw coming. When it comes to Randy Ramsey and his run for State Senate, you've had fair warning. The release of his latest campaign report verifies what I have been saying for months: Randy Ramsey and his "pay to play" friends are trying to buy an election.

Here are just a few of the figures that jump out at you.

Total receipts of over $367,000.

Ramsey has personally contributed over $180,000.  (Why would someone spend over $180,000 of their own money to run for State Senate seat (the Senate annual salary is $13,000/year)? What does Ramsey know that we don't know about being a NC Senator? ~ Lynn)


Over half (52%) of the money generated by personal contributions came from outside the District.

Ramsey received over $20,000 in contributions from Florida, Illinois, Tennessee, Ohio, Maine, South Carolina and Virginia.

One family from a small town in Florida contributed more money than Ramsey's entire hometown of Beaufort.

The report includes a contribution from the N.C. Advocates for Justice PAC, the political action committee of trial lawyers that was the largest PAC contributor in state legislative races in 2010.

The report includes several contributions from individuals who traditional give almost exclusively to Democrats, including Wendell Murphy, who was subpoenaed in the Board of Elections hearings against Governor Mike Easley and was also listed in the list of unreported campaign flights for Bev Perdue. Randy Ramsey was included in that list.

Why would someone spend over $180,000 of their own money to run for State Senate seat?

Why are so many contributors from outside our area and our state pouring money into Randy Ramsey's campaign?

Why is Randy Ramsey running under the guise of a "Conservative Republican" when all the evidence proves otherwise?

The answer to all of these questions is the same: the influence seeker is seeking to become an influence peddler. We cannot let this happen.

There is less than a week until Election Day and Randy Ramsey is flooding the airwaves and mailboxes with distortions of my record. We have exhausted every resource so we need your help now.

The TRUTH

Over the past few weeks, I've spent a large portion of my day listening to the outrage of conservative citizens who are infuriated over Randy Ramsey's distortions of my voting record. The latest deals with the military, and it is even more outrageous than the lies about ObamaCare.

Ramsey is running TV and radio commercials saying I allowed "Loan Sharks" to prey on our military men and women. As with the previous distortions, all that any objective observer would have to do is read the bill referenced (HB 810) to see that it did nothing of the sort.

The bill dealt with changing the laws regarding legitimate lending institutions, not "Loan Sharks", and the interest rates and terms they must abide by. Members of the military often obtain these short term loans for items like furniture or electronics and there was concern that especially our youngest service members might make hasty and possibly unwise financial decisions. Because of this concern, a clause was written in the bill that required any loan to a member of the military to be approved by the service member's commanding officer (the entire section is listed at the end of this email).

Randy Ramsey is desperate. He has put in $100,000 of his own money and been bankrolled with another $100,000 from "pay to play" influence seekers who have a vested interest in winning this Senate seat. He has run phone polls almost daily for two weeks, and I am convinced these polls show that he is behind. That is why he is resorting to these win-at all-cost tactics. Thankfully, those tactics are not succeeding, and it is because a people like you.

I ask you now to forward this email to your entire email list and remind your conservative friends that Randy Ramsey is trying to buy your vote. Let them know about my strong conservative record and why I am the clear conservative choice.

Exception for Military Borrowers. - A licensee may not make a loan to a borrower "(l) who is a military service member unless the military service member obtains a written authorization signed by the service member's company commander. A licensee must include a clear and concise statement in the loan documentation advising the borrower that military service members must identify themselves as service members and must obtain written authorization from their company commander before entering a loan agreement. The licensee shall retain a copy of the borrower's military ID card and the company commander's written authorization in the borrower's loan file. The borrower must attest (i) that he or she is or is not a military service member, (ii) that if the borrower is a military service member, he or she has obtained a written authorization from the company commander to enter the loan agreement, and (iii) that all information presented to the licensee pertaining to the requirements of this subsection is true and accurate to the best of the borrower's knowledge. For the purpose of this subsection "military service member" includes only a person on active duty."

NC--Ferry Tolls Put On Hold

I will continue to work within the system to make sure that no undue economic burdens are placed upon the citizens who rely on the ferry as an important part of their transportation."

Raleigh, NC - Representative Norman Sanderson exited this mornings' Joint Oversight Committee on Transportation meeting pleased that additional tolls on the North Carolina Ferry system have been put on hold. The Committee voted to approve an amendment to the State Budget, striking one key sentence. The sentence slated for removal reads "The Board of Transportation shall establish tolls for all ferry routes, except for the Ocracoke/Hatteras Ferry and the Knotts Island Ferry."

Representative Sanderson has been working to remove the tolls that were part of the total state budget. "This is just another step in the process of removing tolls from the ferries that provide a valuable service to our area. I will continue to work within the system to make sure that no undue economic burdens are placed upon the citizens who rely on the ferry as an important part of their transportation" Sanderson said.

The Legislature will debate and vote on the amendment when they return back to full session, beginning May 16.

Desperate people resort to desperate measures, and there is no better example than my opponent's recent attacks on not just me but the entire North Carolina Republican Party.


By now you may have received a few of these outrageous mailers from my opponent, Randy Ramsey, saying I voted to implement Obamacare. Political distortion has reached a new low as he has misrepresented a bill designed to LIMIT the power of Obamacare, a bill that was supported by every Republican in the State House.

Here are the facts:

The legislation referenced in Ramsey's flyer is House Bill 115 which was a bill that was a safeguard against the Federal Government having total control over Obamacare funding it if became law. There is the full title of that bill: An Act to Preserve State-Based Authority to Regulate the North Carolina Health Insurance Market and Prevent Federal Encroachment on State Authority by Establishing the North Carolina Benefit Exhchange. How can anyone interpret the words Preserve State-Based Authority and Prevent Federal Enchroachment and believe it supports Obamacare? A failure to act would have meant Washington, DC, not North Carolina, would have made all decisions regarding Obamacare. If the Supreme Court rules Obamacare unconstitutional, the bill is null and void.


House Bill 115 was supported by EVERY REPUBLICAN in the State House and even 18 Conservative Democrats. The only opposition came from the most liberal Democrats. Randy Ramsey has taken sides against the Republican Party and said he would have voted with the liberals. Anybody surprised?


The truth is on our side but we have one glaring obstacle to overcome: MONEY. Randy Ramsey is on pace to spend $250,000 in this primary. He has purchased over $100,000 worth of radio and TV this week alone. This type of money spreads his distorted message out to the masses and as I send out this message, we are rushing to produce radio and television ads to respond to these outrageous claims.

A Letter from NC State Representative Pat McElraft

To the Editor:


As a State Representative, I am fully aware that politics is not for the faint of heart. Any elected official understands that they will be judged on their voting record and I stand on my record over the years. But when people distort that record, you must defend yourself and those who stand with you.

Upon hearing of my legislative colleague Norman Sanderson’s intention of running for State Senate, I promptly endorsed his candidacy. I have personally witnessed his conservative values and work ethic in the State House and have no doubt he will be a strong conservative voice for Carteret, Craven and Pamlico counties. After lending my initial endorsement, I made no other public comment. I thought that was the right thing to do as a Republican to let the candidates fight this out. However, I can no longer remain silent since I, personally,and 67 other Republican Legislators have been brought into this with the latest Randy Ramsey Ad and flyer.

State Senate candidate Randy Ramsey recently aired a radio ad and sent out a mailer that accused Representative Sanderson of voting to implement ObamaCare. I was the co-sponsor of the bill that was referenced (HB115) and it was supported by every Republican member of the House as well as 18 conservative Democrats. Only the most liberal Democrats voted against this largely procedural bill that saved North Carolina taxpayers countless dollars. In fact, the full title of the legislation was An Act to Preserve State-Based Authority to Regulate the North Carolina Health Insurance Market and Prevent Federal Encroachment on State Authority by Establishing the North Carolina Benefit Exchange. As the name implies, it was designed to limit the power of ObamaCare. Randy Ramsey’s blatant misrepresentation of this bill was not only an attack on Norman Sanderson but on every Republican who voted for this piece of common-sense legislation.


The very first piece of business for the Republican led legislature in 2011 was passing House Bill #2, entitled Protect Health Care Freedom. I was proud to co-sponsor that bill with Representative Sanderson, knowing that it protected North Carolina’s citizens from ObamaCare and the overreaching authority of the Federal Government into your health care decisions. That important piece of legislation would be law today if had not been vetoed by Governor Bev Perdue.

For anyone to say that Norman Sanderson, myself or any Republican legislator supports ObamaCare is outrageous and a blatant misrepresentation of the facts. Randy Ramsey has either chosen to resort to distortion in a desperate attempt to gain votes or he has not researched the information his campaign team is releasing. Either way, the practice is unacceptable and should immediately cease.

Desperate people resort to desperate measures, and there is no better example than my opponent's recent attacks on not just me but the entire North Carolina Republican Party.

By now you may have received a few of these outrageous mailers from my opponent, Randy Ramsey, saying I voted to implement Obamacare. Political distortion has reached a new low as he has misrepresented a bill designed to LIMIT the power of Obamacare, a bill that was supported by every Republican in the State House. Here are the facts:

The legislation referenced in Ramsey's flyer is House Bill 115 which was a bill that was a safeguard against the Federal Government having total control over Obamacare funding it if became law. There is the full title of that bill: An Act to Preserve State-Based Authority to Regulate the North Carolina Health Insurance Market and Prevent Federal Encroachment on State Authority by Establishing the North Carolina Benefit Exhchange. How can anyone interpret the words Preserve State-Based Authority and Prevent Federal Enchroachment and believe it supports Obamacare? A failure to act would have meant Washington, DC, not North Carolina, would have made all decisions regarding Obamacare. If the Supreme Court rules Obamacare unconstitutional, the bill is null and void.

House Bill 115 was supported by EVERY REPUBLICAN in the State House and even 18 Conservative Democrats. The only opposition came from the most liberal Democrats. Randy Ramsey has taken sides against the Republican Party and said he would have voted with the liberals. Anybody surprised?


The truth is on our side but we have one glaring obstacle to overcome: MONEY. Randy Ramsey is on pace to spend $250,000 in this primary. He has purchased over $100,000 worth of radio and TV this week alone. This type of money spreads his distorted message out to the masses and my campaign needs the money to answer.

As I send out this message, we are rushing to produce radio and television ads to respond to these outrageous claims. I ask you to respond immediately with your financial support so I can get my message out. I need you to respond NOW, as the inventory is limited due to other candidates buying ads.
