The Final Constitutional Option

Having been dormant for centuries, a potent section in the U.S. Constitution is now in the minds and on the lips of a new generation of reformers who are determined to keep the nation out of an abyss.  As America stares hard at the darkness ahead, the new reformers have begun to popularize this forgotten constitutional provision that might well become Official Washington's undoing.

The problem, which hardly needs stating, is that the federal government has become the very monster the founders anticipated.  Quite likely, the beast we face is far beyond anything that could have been imagined by the founding generation.  Even today it is hard to adequately comprehend the omnipresent and, thanks to the NSA, omniscient federal menace that overhangs every aspect of life in 21^st-century America.

The founders' concern that power would be consolidated at the federal level is dealt with in Article V of the U.S. Constitution. 

Author Mark Levin, in his blockbuster best-seller, The Liberty Amendments: Restoring the American Republic, based his ideas for reform on this less well-known means by which amendments may be proposed -- a process that entirely outflanks Washington's fixed fortifications.  Levin cogently argues that attempts at reform from within Washington are futile.

Nullification vs. Article V Constitutional Convention: Where is the Honest and Open Debate?

When the original 13 states came together to discuss the possibility of establishing a confederacy, at the urging of Benjamin Franklin (“Join or Die”), they did so with a great deal of hope, but also a great deal of trepidation. The hope was that a federal government might be formed that could provide greater security and stability to the colonies.  The hope was that it might handle the few issues that were common to all the states but which could not be dealt with by the states individually. The fears, on the other hand, were that this government might come to gain an enormous amount of power; that this power might come to be concentrated in the hands of very few; and that the federal government as a whole might end up overreaching its authority and end up meddling in affairs that ought rightly to be left to the states and the various local governments (if not individuals themselves).

The Constitution created a limited government, which is evidenced in four obvious ways: (1) The Constitution was framed in such a way that the power of the federal government would be split between three separate branches – each acting as a check-and-balance on the power of the others; (2) The power of the federal government as a whole was limited to certain specific areas; (3) Government power structure was split between two co-equal sovereigns – the individual states and the federal government (emphasized or restated by the Tenth Amendment); and (4) A Bill of Rights (“further declaratory statements and restrictive clauses to prevent the government from misconstruing or abusing its powers..”) to put further limitations on government power.

For 200 years, this structure has been eroded, always at the hand of the federal government. After numerous overt acts of usurpation, constitutional amendments, and loose interpretations of the Constitution itself, each of the branches of government has managed to seize more power than it was ever meant to have. Now, as we see and feel most acutely, the federal government involves itself in matters that are neither federal in nature nor are subject to its jurisdiction.  It insinuates itself into virtually every aspect of public and private life, including political, economic, and social.  When we listen to a young mother in Alabama cry because the new healthcare mandate has increased her insurance premiums each month by over $100 and has presented her with a dilemma that is causing her great heartache and distress (she wants to work and do the right thing, but if she does, she can’t afford the increase in healthcare premiums, and so she is faced with the choice that puts and her family on welfare), then we understand how destructive the government has become and how far it has strayed from its intended purpose.

2014: The Resurgence of the Tea Party

It is not looking good for the Tea Party and our efforts to restore America in 2014. The Obama Administration, mainstream media, major liberal advocacy groups and the GOP establishment have launched an extremely well-funded war against us.

So, how do we compete?

Answer: We do what we did in 2010. The Bible says one will put a thousand to flight, but two will put 10,000 to flight. (Deut. 32:30) In other words, when we are united our power and effectiveness increases exponentially. The 2010 Republican sweep of the elections driven by the Tea Party confirms this truth.

Mark Levin explains Obama’s “coup” on the Constitution

God help America when even the American Constitution cannot help prevent an ill-intentioned president from robbing it of its birthrights

While the mainstream media continues to hide the truth from Americans, what happened today in Washington, D.C. was a Congressional stand down during the brazen daylight robbery of America’s financial security.

 

The lying mainstream media and the talking heads will provide cover for the Barack Obama regime, hiding what happened in the White Noise that comes with all they report.

Knowing what was coming today, Mark Levin called the act giving Obama total control of the purse strings what it really is on his radio show last night. Levin called it what it is: “a coup”.

Levin explained in plain English how Obama holds the nation at ransom in order to seize the power of the purse from Congress.  What Obama did is a first, because it absolutely guts the Constitution. 

Other players throughout history who have pulled palace coups in democratic societies have been led away from the corridors of power in handcuffs, and worse.

CCTA EDUCATION CLASSES

Dear fellow CCTA members and friends,

We are starting a new book study on Saturday, October 5 and hope you will join us.  Our new book is “The Liberty Amendments” by Mark Levin.  Mr. Levin has introduced this blueprint on his suggestion as to how we can use Article 5 of the Constitution to stop the advance of the progressives and the destruction of our Nation.  

Come join us at 11:30 am at Highland Christian Church, 905 Carolina Ave., New Bern, this Saturday.  Local bookstores have the book or you can purchase it at Amazon.

We are in our third week of “The Making of America”, so it’s not too late to join us.  There is no book associated with this class, but we watch a video and engage in stimulating discussion.  This class is free and is at 10 am at Highland Christian Church as well.  This is the first time we have done this seminar, and all the attendees are enjoying it very much.  We will certainly be repeating this class in the future as it’s a winner.

Convention of States to amend the Constitution

Mark Levin was on Hannity's show recently discussing his new book, "Freedom Amendments". it will run again tonight Sun 8/18, at 6:00PM. Try to catch it, It was excellent. Levin is a man of ideas, but achieving them will require an undertaking of monumental proportions. We need 2/3 of the states to order a convention aimed at amending the constitution. We need 3/4 of the states to approve the amendments for passage. How are we going to accomplish that?

The amendments Levin proposes are comprehensive and necessary to save our Republic. I wrote my state representative  and Governor 2 years ago asking them to work with other state governments to convene a constitutional convention. I never received a reply. This time however, I am not a lone voice. We need 33 states to  demand a convention,, and 38 states to approve the changes.

Please join the movement at www.conventionofstates.com , Write/call/visit your state legislatures. Congress is not going to rein in their power on their own. This is our only hope for returning the government to its rightful owners, short of revolution.

Articles: How to Make Mark Levin's Vision of Constitutional Reform a Reality

Mark Levin, the well-known constitutionalist talk show commentator, has written still another very good book.  This book, called the Liberty Amendments, is essentially an operator's manual on how constitutionalists in America might restore constitutional government while bypassing the entrenched federal interests in Washington DC. 

Levin's strategy lies in taking advantage of Article 5 of the US Constitution that gives the power to the states to call a convention, propose amendments, send the amendments out to the state legislatures for passage and all the while, the states can completely ignore the powers in Washington DC.  (See Thomas Lifson's book review.) Levin provides a list of suggested amendments which, if passed, would force the federal government to reverse its century old expansion of federal power and gradually restore a more balanced form of constitutionalist government that the Founders originally intended. 

But there is a serious risk in Levin's strategy that lies in the phrase "Article 5 convention."  Never in American history have the states invoked their Article 5 powers --and for good reason.  State legislators have always been afraid that such a national convention might slip from their control and become a "rogue convention."  Constitutionalists in particular conjure up the nightmare image of statist progressive convention delegates pushing through an agenda that would shed what is left of the protections of the original Constitution.  If you bring up the subject of an Article 5 convention to most state officials, you can see their minds close faster than they can blink.  If you don't believe me try it yourself on your own state assemblyman and witness for yourself the reflexive pavlovian reaction. 

In the real world of flesh and blood humans, I fear that Levin will not gather enough support even from his own constitutionalist allies who admire him greatly.  Levin himself should understand this, for he also once opposed an Article 5 convention, and I suspect the only reason he has changed his mind is that he is desperate for a solution that is not dependent on the cooperation of the status quo contented Republicans residing in their plush neighborhoods in Washington DC. 

But fortunately for Levin (and us all), there is a solution to the runaway convention problem, and his "natural allies" could find reason to hop on his Article 5 bandwagon.  There is a group based in Washington DC of highly influential constitutionalists who call themselves the Madison Coalition and who have found a workable solution to afford states the right to propose single Constitutional amendments while avoiding the dangers of a runaway convention.  The first article in the nation to report on the Madison Coalition was published on these pages.  Very briefly, the Coalition's strategy is to first have the states draft carefully crafted legislation that would eliminate the possibility of the delegates in an Article 5 convention from "going rogue."

Today marks the publication of Mark Levin's important new book, The Liberty Amendments. I must confess that I had some trepidation when starting to read it, for as the editor of American Thinker I turn down most submissions that propose amending the Constitution as a solution for what ails us. The reason is simple: amending the Constitution is deliberately difficult to accomplish, so changing it is a solution easy to propose and difficult to dispose.

But Mark, whose body of work as a political thinker includes not just the significant tomes Men in Black, Liberty and Tyranny, and Ameritopia but also three hours a day of extemporaneous political talk on one the nation's most popular syndicated talk shows, is in a different category. And not simply because of his stature. The Liberty Amendments consists of a well thought-out program of amendments (offered as a starting point for discussion and modification), combined with a political strategy that could (at least potentially) work: using a constitutional convention called by two-thirds of the states. As Article 5 of the Constitution reads:
