In an amicus brief filed today in support of the Commonwealth of Virginia’s case against the Affordable Care Act (ACA), physicians ask the U.S. Court of Appeals for the Fourth Circuit to affirm the unconstitutionality of the individual health insurance mandate (Section 1501), and also to hold that it is not severable from the rest of the Act.
The brief is filed by the Association of American Physicians and Surgeons (AAPS) and several individual physicians.
“ACA is the most divisive, harmful, and unconstitutional legislation enacted by Congress in a generation,” observes AAPS counsel Andrew Schlafly. In addition to Virginia, 27 other states have challenged ACA’s constitutionality.
The individual mandate cannot be justified under the Commerce Clause, which allows Congress to regulate commerce “with” the Indians, “among” the several States, or “with” foreign nations. AAPS argues that no commerce is involved in an individual’s decision not to purchase government-approved health insurance. All types of commerce must involve at least two parties, such as a buyer and a seller, or a borrower and a lender.
Congressional “findings” as regarding a “substantial effect on the economy,” are not entitled to deference, AAPS argues. In the case of ACA, they are based on assumptions and extrapolations, some of which contradict each other.
Various portions of ACA also contradict each other. Sections 1501 and 10106, enacted simultaneously, contain incompatible definitions of “penalty amount.” The process of simultaneously enacting and revising the ACA violates the Presentment Clause.
“This unconstitutional practice completely infects ACA. Indeed, … Congress attempted to simultaneously enact and amend more than ninety ACA provisions,” AAPS notes.
The ACA is also an assault on patient privacy. To enroll in an insurance plan, patients must routinely divulge their entire medical history. The right to a “private enclave” has been recognized in many court decisions, and underlies Fourth and Fifth Amendment jurisprudence. Under ACA, patients have fewer privacy rights than perpetrators of violent crimes.
AAPS argues that the attempt to sever the individual mandate and preserve the rest of the law amounts to an impermissible “judicial line-item veto.” Moreover, both Congress and the Administration have argued that the law cannot function without the mandate. Thus, it must be voided in its entirety.

When Will The People Of Walmart Wake Up To Inflation?

Serious price inflation will come this summer.
Although I have warned readers for some time that hyperinflation is coming, this is not me saying it, but Walmart CEO Bill Simon. Last week he told USA Today that inflation is “going to be serious” in the coming months.
“We’re seeing cost increases starting to come through at a pretty rapid rate,” he said.
Of course, back in October 2010, Federal Reserve Chairman Ben Bernanke promised that inflation was his goal. “For the first time in many decades, [the Fed] had to take seriously the possibility that inflation can be too low as well as too high,” he said.
“Every single retailer has and is paying more for the items they sell, and retailers will be passing some of these costs along,” John Long, retail strategist at Kurt Salmon told USA Today. Along with steep increases in raw material costs, labor costs in China and fuel costs for transportation are weighing heavily on retailers, he said.

It's time for a tea-party insurrection

Wednesday evening, word began to leak out that John Boehner was going to make a deal with the Democrats. Instead of the $100 billion that the GOP had promised in cuts, there would only be around $33 billion in cuts, and the riders that would defund Obamacare, Planned Parenthood and NPR would be dealt with separately. In other words, they would be put in bills that have no chance of ever becoming law.
The time-honored Republican tradition of surrender is in full swing in Washington today.
The problem is, the American people and the tea-party movement did not send Republicans to Washington to surrender. We sent them to cut the budget.
In a couple of weeks, the government will hit the debt ceiling. In other words, the government will have borrowed all of the money it is allowed to borrow. It must either get authorization to borrow more money or stop spending.
John Boehner has demonstrated that he has no stomach for a fight and no commitment to stopping the insane spending that is sending this country into insolvency.
Two years ago, the tea-party movement arose with a simple message. We will not sit back quietly while the extreme liberal fringe spends this country into bankruptcy and poverty.
The Republicans talked a good game during the election season. Even after the election season, Boehner has talked about the need to cut spending. Wednesday, on his website, his staff posted an article about how high deficits and debt kills jobs. John, if you believe this, why aren't you cutting spending?
Besides the time-honored Republican tradition of surrender, another Republican tradition is also going on. Republicans come home and talk a great conservative game, and then when they get back to Washington, they forget their beliefs and fold to the Democrats.
No more. It is time, again, for a tea-party insurrection.
We have two issues to fight. First is this budget. Reducing spending by $33 billion in the face of a $1.65 trillion deficit is not a cut; it is a joke.
We need to stop this budget and refuse to let the GOP off the hook unless there is a complete defunding of Obamacare, Planned Parenthood and NPR. The GOP ran on defunding Obamacare. For better or worse, we believed them. Now it is time for them to honor their promises to us.
The events of the last few days have made it painfully obvious that the GOP leadership is not serious about dealing with the out-of-control spending in Washington.
If they will not be serious about it, we must make them serious. We must use every tool at our disposal, calls, emails, tweets, faxes and personal visits to tell the Republicans not to raise the debt ceiling.
The Republicans in Congress have the budgetary "nuclear" option at their disposal! Let them know you expect them to use it by sending a message to all 241 GOP House members via the "No More Red Ink" campaign
When Washington hits the debt ceiling in a few days, our national debt will be 100 percent of our gross domestic product. In plain, non-lawyer English, this means that to pay off our national debt, it would take every cent of wealth America generates in 2011. There is a term for this; it is called insolvency.
The debt ceiling has been raised a number of times in the last 10 years. Each time, we are promised that fiscal discipline is right around the corner. The only thing that ends up being around the corner is yet another need to raise the debt ceiling.
Debt at 100 percent of GDP is something of a psychological marker. If we are not going to stop spending now, when will we?
Stopping the spending is actually simple. All we need are 218 House votes not to raise the debt ceiling, and Congress will have to balance the budget.
Will there be negative consequences if we do not raise the debt ceiling? Possibly. But what will be worse? Problems now or problems when the national debt is $28 trillion and we really are insolvent. Any problems we would have now pale in comparison to a national economic collapse.
It is time for the tea party to stand up and tell Congress, "No!" Do not spend any more money. Cut the spending, and under no circumstances raise the debt ceiling. Call, fax, email, tweet and visit your congressman's office, and tell them this.
At Tea Party Nation, one of our favorite sayings is: It is not enough to simply to replace bad leadership. We must put good leadership in its place. When we kicked Nancy Pelosi out of the speaker's chair, we replaced bad leadership. So far, we cannot say that we have put good leadership in its place.
We have a simple message to the GOP leadership. Cut the budget, do what you promised, and do not raise the debt ceiling. Do the right thing now, or we will do the right thing next year at the ballot box.

The Thomas More Law Center announced today that the City of Dearborn, its Mayor, John B. O’Reilly, its Chief of Police, Ronald Haddad, 17 City police officers, and two executives of the American Arab Chamber of Commerce were named as defendants in a ninety-six page federal civil rights lawsuit filed in the Federal District Court in Detroit this morning.
The lawsuit, brought by TMLC and co-counsel and Sharia law expert, David Yerushalmi, stems from two separate police actions at the June 2010 Dearborn, Michigan Annual International Arab Festival.
Richard Thompson, TMLC President and Chief Counsel, commented, “Muslims dominate the political and law enforcement process in Dearborn. It seems that police were more interested in placating the Mayor and Muslims than obeying our Constitution. Sharia law makes it a crime to preach the Gospel to Muslims. This is a classic example of stealth Jihad being waged right here in America. And it should be a wake-up call for all patriotic Americans.”
The first incident occurred on June 18, when police jailed four Christian missionaries when they witnessed Dr. Nabeel Qureshi, a Muslim convert to Christianity, peaceably discussing his Christian faith with Muslim youths. The other three, David Wood, Paul Rezkalla, and Negeen Mayel, were arrested along with Qureshi for allegedly “breaching the peace.” The Christians were led away in handcuffs by police to the applause and cheers of Muslim onlookers who just witnessed a victory of Sharia law over the Christians.

The second incident occurred on June 20, as two missionaries, Rezkalla and Josh Hogg, stood on the public sidewalk handing out the Gospel of John to passersby willing to take them. The Christians were there for approximately 5 minutes when eight City police officers descended upon them, seized them, and brought them to the police command trailer located inside the festival where the Christians were admonished, photographed, and ordered to stop their peaceful religious activity.

The police assaults and arrests of the Christians, captured on video, caused a national furor over the lawless tactics of the City’s police department.
Dearborn is considered home to the largest Muslim population in America. As a result, it is evident that City officials, including the Mayor, engaged in this unconstitutional official action solely to please this significant voting bloc and to submit to its will.
The lawsuit was filed on behalf of Acts 17 Apologetics, Dr. Nabeel Qureshi, David Wood, Paul Rezkalla, Negeen Mayel and Josh Hogg.

‘Unconstitutional’ Health Care Law One Step Closer to Supreme Court
The American Affordable Care Act–the president’s signature piece of domestic legislation–is one step closer to the Supreme Court.
