1. Appointment of a “shadow government” of some 35+ individuals termed “czars” who are not confirmed by the Senate and respond only to the president, yet have overarching regulatory powers – a clear violation of the separation of powers concept. Obama bypassed the Senate with many of his appointments of over 35 “czars.”

2. No congressional support for Libyan action (violation of the War Powers Act ). Obama lied to the American people when he said that there were no US troops on the ground in Libya and then later said they were only “logistical troops.” Obama violated the War Powers Act of 1973 by conducting a war against Libya without Congressional authorization.

3. Betraying of allies ( Israel and Great Britain. Obama has placed the security of our most trusted ally in the Middle East, Israel, in danger while increasing funding to the Palestinian Authority (Fatah, just another Islamic terrorist group) whilst they have enjoined a reconciliation pact with long-standing terrorist group Hamas and the disclosure of British nuclear secrets to the Russians in the Start Treaty.  Obama gave missile codes to British Trident missiles to Russia.

4. Backdoor implementation of the DREAM Act which would grant 22 million illegals amnesty. Obama passed the Dream Act through an executive order, bypassing Congress again. DREAM is: Development, Relief and Education for Alien Minors

5. Telegraphing troop reductions to enemies – against the consult of his experienced field commanders – while embracing negotiations with our enemy, the Taliban, and recognizing another, the Muslim Brotherhood.

6. Betrayal of Arizona. Obama brought a federal lawsuit against a sovereign state, Arizona, seeking to protect its citizens from this threat of mass illegal immigration

7. Obama’s Failure to enforce U.S. law, the Defense of Marriage Act. He’s stripped America of its moral base by his support for homosexuality and the attack on marriage between a man and a women Obama allows the DOJ to refuse to enforce the Defense of Marriage Act.

8. Support of an inept and incompetent attorney general who has failed to prosecute voter intimidation cases (New Black Panther Party), initiated a dangerous gun-smuggling program (Operation Fast and Furious) – which resulted in deaths to one of our own law enforcement agents. Obama allowed Operation Fast and Furious to occur, which allowed hundreds of Mexican nationals and Border Agent Brian Terry to be murdered with illegal arms given out by the ATF and DOJ.

9. Increasing the regulatory burden on American business through bypassing the legislative process with his executive branch agencies such as the Environmental Protection Agency and the Food and Drug Administration.

10. Failure to take the steps necessary to secure our borders and stem the flow of illegal immigration, termed as “repel invasions” in our United States Constitution in Article 1, Section 8 and Article 4, Section 4. Obama has failed to defend US soil in Arizona as Mexican troops bring illegals and drugs into the USA, crossing the border doing so. This is a direct violation of Article IV, Section 4 of the Constitution.

THE PATRIOT POST: Rule of Lawlessness

For four and a half abominably long years, we have recounted Barack Obama's lawlessness. He makes his own laws and ignores others, consistently showing an intractable contempt for Rule of Law. In a rebuke to the president, however, the DC Circuit Court of Appeals last week issued a writ of mandamus, an unusual direct judicial order for the government to satisfy its legal obligation.

The matter at hand is Nevada's Yucca Mountain nuclear waste storage facility. Long story short, candidate Obama promised to close the facility, and after he was elected his Energy Department attempted to revoke the Yucca Mountain license application. A U.S. Nuclear Regulatory Commission (NRC) safety board ruled unanimously that he couldn't do that -- so Obama stacked the NRC with appointees who shared his opposition to Yucca. The NRC then refused to conduct a review of the facility for licensing, despite a 1983 law requiring the review and Congress appropriating money for said review.
Writing for the DC Court, Judge Brett Kavanaugh said that "the Commission is simply flouting the law." Hence the writ of mandamus. Not only that, wrote Kavanaugh, but the case "raises significant questions about the scope of the Executive's authority to disregard federal statutes." While a president may choose not to enforce laws on constitutional grounds, Kavanaugh added that "the president and federal agencies may not ignore statutory mandates or prohibitions merely because of policy disagreement with Congress."
Obama enacted DREAM immigration policy without Congress, he delayed major aspects of his own health care law without Congress, he declared Congress in recess so as to appoint people to the National Labor Relations Board -- and that's not to mention his other "phony scandals." We're glad to see that, at least in this case, the Founders' system of constitutional checks and balances is still active.

WHITE HOUSE BOASTS 430K ILLEGALS RECEIVED ‘DEFERRED ACTION’ ON POLICY’S ANNIVERSARY

BUT CRITICS CITE SECURITY GAPS

The White House boasted that 430,000 children of illegal immigrants have received temporary exemption from possible deportation, in marking the one-year anniversary this week of implementing the executive action taken last year.
But critics say the program has led to more lax security, particularly citing a “lean and lite” background check policy for applicants in the program.
The Deferred Action for Childhood Arrivals, an executive action first announced in June 2012 by the Department of Homeland Security, was not implemented until Aug. 15 last year. The politically-charged move came after Congress rejected a similar proposal called the DREAM Act to give permanent status to children of illegal immigrants who go to college or join the military.

Talking Points:

1. Giving work permits to illegal youth, when we have such high unemployment, especially when the unemployment rate of black youth is skyrocketing, will only further exacerbate unemployment of citizens and increase costs for the unemployed, legal and illegal.


2. The President is giving speeches about improving the economy. This Executive Order is antithetical to improving the economy.

3. This act will encourage more illegal immigration and flood the border with parents bringing children to the U.S., further deteriorating U.S. security.

4. The President is becoming increasingly dictatorial and is overriding Congress' power. Congress voted against the DREAM Act. The President has admitted in the past that he could not act against this. Now apparently he has decided that he can.

Obama Tip-Toes Around E-Verify; Continues to Push for Amnesty


At a press conference in the White House last week, President Obama avoided answering whether he would sign a mandatory E-Verify law if Congress presented one to him. “[I]f you receive a mandatory E-Verify bill only, without legalization, are you planning to veto that bill?” a reporter asked the President. “[W]e need comprehensive immigration reform,” replied the President. “I’ve said it before, I will say it again, I will say it next week and I’ll say it six months from now.” Indicating he wanted an amnesty attached to the E-Verify legislation, the President added, “We may not be able to get everything that I would like to see in a package, but we have to have a balanced package.”

Congressional Republicans rejected the notion of allowing mandatory E-Verify to be hijacked as part of a comprehensive immigration reform bill. “E-Verify should be considered as a stand-alone bill,” said House Judiciary Chairman Lamar Smith (R-TX). (CQ Today, June 29, 2011) “It is not an immigration bill, it’s a jobs bill,” he said of his own mandatory E-verify legislation. (Id.) Sen. Chuck Grassley (R-IA), ranking member of the Senate Judiciary Committee and chief sponsor of mandatory E-Verify legislation in the Senate, also rejected the President’s remarks. “[At the Dream Act hearing], members of the president’s Cabinet, who claimed to be speaking for the administration, said they wanted an individual piece of immigration legislation passed. Yet today, the president said we have to consider E-Verify in a comprehensive immigration plan. It seems like the president wants it both ways.” (Id.)

The Lamest Duck

President Obama at a White House press conference on Dec 22, 2010 was jubilant that the so-called "lame-duck" Congress delivered victories for him on a number of initiatives. "Obama said Congress had its 'most productive post-election period' in decades." "And it comes on the heels of the most productive two years that we've had in generations." (Bloomberg News) Recall that when Republicans were the "lame duck" Congress they passed zero legislation.

President Obama's only one regret is that the DREAM Act did not pass, but he has vowed to continue again with the next Congress. A true picture of "accomplishments" includes a 2011 annual budget that was not passed but temporary extensions were granted to keep the government running, a 2010 unemployment rate of 9.8%, and a deficit of $1.3 trillion.

Most Recent Congressional Actions

Senate--New START Treaty.

On Dec 22 the Senate ratified the new START treaty, a nuclear arms reduction treaty with Russia. The vote was 71 to 26 and 3 did not vote. Senator Burr voted against it and Senator Hagan voted for the treaty. Eleven Republicans broke rank and voted with the Democrats and they are: Senators Alexander (TN), Brown (MA), Cochran (MS), Collins (ME), Corker (TN), Gregg (NH), Isakson (GA), Johanns (NE), Lugar (IN), Murkowski (Alaska), and Snowe (ME).

A key problem with the treaty is that it allows Russian coordination over U.S. plans for a global missile defense system. Interestingly, Russian Foreign Minister Sergei Lavrov recently warned the U.S. Senate that the New START treaty "cannot be reopened, becoming the subject of new negotiations," according to the British Broadcasting Corporation (BBC).

Don't Ask, Don't Tell Repeal Act of 2010

The legislation passed on Dec 18, which allows gays and lesbians in the military services to openly flaunt their sexual preferences. The vote was 65 to 31 with 4 not voting. All Democrats voted for the repeal, except Senator Manchin (D-WV) who did not vote. Both Senator Burr and Senator Hagan voted for the repeal.

Eight Republican Senators voted with the Democrats including Senators Burr, Kirk (IL), Ensign (NV), Brown (MA), Voinovich (OH), Murkowski (Alaska), Collins and Snowe (ME).

Senator Burr's vote was a surprise since he did not indicate his support for the repeal previously, and initially agreed with Republicans in a procedural vote in bringing the measure to the floor. However, when the final vote was taken he voted for repeal. Politico reported that Senator Burr said, "It's just that we've had a generational change and I have vehemently objected to making a policy change of this magnitude at this time. When cloture was passed, that settled that," "It's not accepted practice anywhere in our society, and it only makes sense. But again, I was vehemently opposed to the timing of this."

[In checking Senator Burr's website several times, no comment is posted concerning his vote, as of Dec 23, 2010. His office is closed for Christmas, but they will be contacted for a comment upon reopening.]

According to Politico, Senator Collins said, "I didn't expect eight. I was delighted but surprised with the vote from Sen. Burr. I think that was a gutsy vote and I was delighted. But he was not someone who I thought to lobby on the issue." [A lot of people were surprised.]

Gay-rights leaders and White House officials were on hand to congratulate themselves for legislation which just a week ago was thought to be dead. Repeal of Don't Ask, Don't Tell is "historic," according to Obama and reported by Politico. Joe Solmonese, president of the gay-rights group Human Rights Campaign said, "Today, we pulled out a victory from what was almost certain defeat just a few days ago."

Pat Buchanan believes this is a "political payoff" to the "homosexual rights lobby," at the "expense of our military." Among the military most opposed to the repeal are combat veterans who "warn that this will create grave problems of unit cohesion and morale." Buchanan also stated, "Marines have been sacrificed by the Democratic Party and Barack Obama to the homosexual lobby, with the collusion of no fewer than eight Republican senators."

Continuing Appropriations Act 2011

On Dec 21, the Senate passed a fiscal year (FY) 2011 funding bill to keep the government running through March 4, 2011. Senator Burr voted against it and Senator Hagan voted for it. The funding continues at the FY 2010 levels since the Congress has not passed a 2011 budget. The 2010 budget deficit is about $1.3 trillion, but the accumulated debt is nearly $13.9 trillion while the debt ceiling is at $14.3 trillion, according to the Wall Street Journal.

9/11 Healthcare Bill

The Senate unanimously approved the bill on Dec 22 for first responders who became ill as a result of 9/11. The $4.3 billion bill funds healthcare for the first responders at $1.8 billion and allows $2.5 billion to "re-open the Victim's Compensation fund," according to Senator Gillibrand's (D-NY) office. [Note: Exact cost figures are slightly different in other publications, but approximate these.]

House of Representatives

Food and Drug Administration Food Safety Modernization Act

On Dec 22, the House agreed with the Senate amendments and passed legislation in a vote of 215 to 144 with 74 not voting.

The House passed legislation to fund the healthcare of 9/11 responders on Dec 22, and the vote tally was 206 to 60 with 168 not voting.

The Liberal Progressive Amnesty Scam

So, the DREAM Act went down yesterday. As we all know this had nothing to do with a dream. Martin Luther King had a dream. The DREAM Act was a scam.

Another cleverly disguised attempt by the Liberal Progressives to grant amnesty to criminals in our country. Illegal alien still means criminal trespasser. Oh yes, they veiled it in such sanctamonious fashion as it being about innocent children. Poor progeny of criminal parents who came here illegally. Illegal aliens taking advantage of our outdated and unenforced immigration laws. Crossing our porous borders as easily as we travel from state to state they invade our sovereign soil and abuse our tolerance and leniency. Using and abusing our antiquated laws to create anchor babies knowing this will possibly increase their chances of staying here permanently. Then exploiting our generous social programs even when they know they are here unlawfully.

The sheer audacity of the Liberal Progressives to conive a plan that will try to prey on the compassionate nature of Americans regarding children is an insult. They knew very well this was not about the children, this was about opening the floodgates for another mass of votes. Their condescending attitude to anyone who would suggest that it was anything more than garnering votes for the next election cycle is an outrage to all of us. The liberal mind is not only deluded in their social justice and collective mentality it is more deceptive than most criminal elements in our world. They will literally lie through their teeth to advance their socialist agenda and maintain their power base to fundamentally transform America. Constitutional adherence and common sense have long since left the Liberal vocabulary. This is no more than creating a nanny state from the greatest Republic known to man.

Of course we know that if the DREAM Act passes the obvious next step will be to grant amnesty to the childs parents to compassionately support their children through school or the military. Along with the parents will be the siblings and any other family members that can be allowed in under the guise of social justice and keeping their collective together. The Liberals will of course praise this as the absolute concern they have for everyone but legal American citizens. We are taken for granted. They will purport that their empathy and humane nature is superior to everyone elses, that's why they just want to help the poor children. Claiming that these children deserve an education or to serve in our military as a result of their parents criminal activity is absolutely non-sensical. If the compassion for the children is so great how can it be argued that allowing them to stay with the same criminal element that created the problem is in the childs best interest? Only in the deluded mind of the Liberal Progressive can this be acceptable.

How can the proof be obtained of arriving before the age of 16, proof of residence for 5 years and be of good moral character? We can barely screen the criminals caught by ICE and law enforcement. Six years of "conditional" status will be monitored how? By more massive government bureacracy that's how. Over the 6 year temporary residence period only two years of compliance of being in school or in the military are required. What will be happening for the other 4 years? How will they be cared for, by who, under what conditions, at who's cost? If after the 6 year conditional period the requirements are not met they could be deported. Could be deported? Are there other options? Extensions? if so how long? In-state tuition rates will be granted under IIRIRA (Illegal Immigration Reform and Immigrant Responsibility Act) but other applicants won't. It seems not only do the illegal aliens get preferential treatment they get more affordable educatiions than our own children with permanent residence.

For decades our government has been negligent in its Constitutional duty of protecting our borders. Lending a blind eye in the name of cheap labor and resultant improved commerce. A once considered nuisance has become a horrible national nightmare. Crime, violence, drugs, human trafficking, prostitution and murders of our own citizens. The murder of Arizona rancher Robert Krenz on his own property, shot multiple times, should have created an outrage. Yet the mainstream media handled it with kid gloves because we wouldn't want to insult the criminal element from that wonderful bastion of humanity called Mexico. Would we. Then we had poor little Nikki Diaz, candidate Meg Whitman's former housekeeper, who was paraded out during the campaign to exploit her own illegal status that was appropriately dealt with years ago. She was, of course, portrayed as a victim by the Liberal media and Democrats even though she falsified her own documentation. And now of course she is suing Mrs. Whitman because she didn't get Diaz a baby gift. Only in America can such stupidity exist. Much more seriously however David Michael Hartley 30, and his wife Tiffany Hartley, 29, were allegedly attacked on Falcon Lake, near the southern tip of Texas by Mexican pirates, the murder still remains unsolved. Most recently Border Patrol Agent Brian Terry was shot and killed last week by 5 men, four are in custody and one remains at large. These crimes and murders don't seem to concern our current administration as Arizona and other border states struggle to maintain their citizens safety. Instead our empty suit president allows a law suit to be issued against the state by the Justice Department and stands shoulder to shoulder with Pepe Calderón, Mexico's president, and allows him to belittle our country and its laws in front of our Congress. In the meantime over 30,000 violent deaths occured so far this year in Mexico. I can understand where we would value Calderón's opinion while his own country has become a war-zone.

The defeat of this Bill must not be construed as the end of debate. Liberal Progressives will stoop to any level to expand their voting block for 2012. After all this is the only matter that concerns them. The well being of our own childrens educations has not been an issue for decades so why would we think they care about them when they can attract a few million illegal aliens and provide them an education? Because at some point a great amount of them will become citizens either through conventional means or through a back-door policy such as this. As citizens they will vote. Votes equal power. Power allows them to continue their Liberal Progressive march to reducing the greatest Republic in the history of man to the scrap heap known as socialism.
