The Unconstitutional Perfecta

Townhall.com, Hank Adler, February 15, 2014

The President has reached "You have to be kidding!" stage of executive orders. The latest executive order with respect to Obamacare, as summarized in the Treasury Department 'Fact Sheet', provides:

The employer responsibility provision will generally apply to larger firms with 100 or more full-time employees starting in 2015 and employers with 50 or more full-time employees starting in 2016.

While the employer responsibility provisions will generally apply starting in 2015, they will not apply until 2016 to employers with at least 50 but fewer than 100 full-time employees if the employer provides an appropriate certification described in the rules.*

* Those that claim the exemption for 2015 will need to certify under penalty of perjury that they did not reduce their workforce to fewer than 100 employees in order to qualify.
Nothing about this executive order passes constitutional muster:

Executive orders cannot create or change law. Executive orders are for the purpose of administrating law.

Obama moving on minimum wage hike

The Hill, Justin Sink, February 12, 2014

President Obama will sign an executive order formally raising the minimum wage for federal workers during an event Wednesday at the White House.

The move, first announced during the State of the Union address, will raise the minimum wage for federal workers hired under new contracts to $10.10 per hour. It will also raise the tipped minimum wage to $4.90 from $2.13 per year, with an escalator clause that will increase that amount in subsequent years.

Obama will also press Congress to match the executive order with an equivalent hike to the federal minimum wage, the White House said Tuesday. According to a source familiar with the event, the president will appear alongside workers who are paid at or just above the federal minimum wage of $7.25 per hour.

Why I Submitted a Comment Objecting to the IRS Proposed Rule Targeting 501(c)(4) Groups

By Loren Heal, FreedomWorks, February 5, 2014

The Internal Revenue Service is attempting to change the standards for tax exempt status for 501(c)(4) groups. Rather than sticking to enforcing the will of Congress, the IRS, with the full blessing of the political operation in the White House, wants to ensure they won't have to harass conservative and tea party groups about their tax exempt status applications, because those groups won't even bother to apply. They need to hear from America.

Following its targeting of tea party and conservative groups in the runup to the 2012 election, the IRS now wants to codify into regulatory law the organization's illegal and tyrannical behavior. The rules are meant not just to stifle free speech, which would be bad enough, but to favor progressive groups over conservative and libertarian ones.

After initially calling the IRS targeting "outrageous," President Obama shifted to calling it a "phony scandal."  The White House and its allies in Congress have worked hard in favor of the new targeting

Michelle Malkin: You’ve entered the ‘Promise Zone’

By Doug Power, January 10, 2014

A year after promising to direct federal attention and support to needy areas across the country, President Obama said Thursday that the government would begin helping five economically hard-hit communities fight poverty and assist children.

In a ceremony in the East Room of the White House, Mr. Obama said the five areas would become “Promise Zones,” where federal agencies will cut through red tape in an effort to give struggling residents a chance at better lives.

OBAMA REVEALS FIRST FIVE ‘PROMISE ZONES’

The Blaze, January 9, 2014

More political maneuvering.  (One goal at least is to break Mitch McConnell's reelection bid.  If he votes for it--conservatives will walk, if he votes against it, he is another mean old republican that wants people to suffer.  ~ Lynn)

President Barack Obama at a White House event Thursday identified five new “Promise Zones” that he said would benefit from a program of tax incentives and government grants, a year after he unveiled the plan in his 2013 State of the Union address.

“We’ve got to keep our economy growing,” the president said. “We've got to make sure everybody is sharing in that growth. We’ve got to keep creating jobs. Then we’ve got to make sure wages and benefits are such that families can rebuild a little security.”

The proposal unique in that they’re an example of administrative action Obama can take without Congress.

“We’ve got to make sure this recovery, which is real, leaves nobody behind,” the president said. “That’s going to be my focus throughout the year. This is going to be a year of action. That’s what the American people expect. They are ready and willing to pitch in and help.”

The “Promise Zones” announced Thursday will be located in San Antonio, Philadelphia, Los Angeles, southeastern Kentucky and the Choctaw Nation of Oklahoma.

New IRS rule could cut into restaurant workers’ tips

Even as President Obama and progressive activists are trying to sell the nation on hiking the national minimum wage to help restaurant workers and other low-wage employees, the Internal Revenue Service is seemingly determined to make life harder for those same workers.

A change in tax policy implemented Jan. 1 will prevent restaurant workers from collecting automatic gratuities — the added 18 percent fee many restaurants charge to groups of eight or more — as part of their tips. Instead, that added fee will be included in their payroll, meaning workers have to wait up to two weeks to get that extra cash and must pay additional taxes on it.
It means less money in servers’ pockets and more for the federal government.

Senate advances budget deal (Cloture)

The Hill, December 17, 2013

"To offset the restored sequester cuts, the bill would reduce federal employee retirement benefits by $6 billion. Military retiree benefits are also cut by $6 billion."

The Senate on Tuesday advanced a two-year budget deal in a 67-33 vote, setting the measure up for final passage.

Twelve Senate Republicans joined all 55 Democrats and Independents on Tuesday to advance the bipartisan budget deal approved in a landslide House vote last week. President Obama also supports the measure.

The bill sets top-line spending levels for 2014 and 2015 and reduces the sequester spending cuts by $63 billion over the next two years.

Despite opposition from conservative groups such as the Club for Growth and Heritage Action, GOP Sens. Saxby Chambliss (R-Ga.), John Hoeven (N.D.), Lamar Alexander (Tenn.), Rob Portman (Ohio), Roy Blunt (Mo.), John McCain (Ariz.), Johnny Isakson (Ga.), Orrin Hatch (Utah), Susan Collins (Maine), Jeff Flake (Ariz.), Lisa Murkowski (Alaska) and Ron Johnson (Wis.) voted to end debate on the measure.

The rest of the GOP conference, including Minority Leader Mitch McConnell (Ken.), who faces a tough reelection race next year, voted against it.

Sens. Marco Rubio (Fla.), Ted Cruz (Texas) and Rand Paul (Ken.) all voted no.

KAY OWNS OBAMACARE LIES

People Who Like Their Health Insurance Can Keep It With ObamaCare

Kay Hagan aided and abetted O-Care’s ‘You can keep your plan’ LIE--Facts can be such troublesome things.  The mainstream media has been gushing over the “courage” shown by Senator Kay Hagan — affectionately know in many quarters as Chuck Schumer’s Sock Puppet™ –for her efforts to seek a delay in the ObamaCare enrollment deadline.  The problem for Madame Pantsuit here is that she was out front from the very beginning peddling the spin — that we all now know was a lie — that you can keep your existing health plan if you want to.

Treason means not agreeing with our President???

Today there was an article in the SunJournal New Bern  by an individual who accuses all those who refuse to lockstep with the President and the Senate of the United States as traitors to their country.  This letter fundamentally displays why this country has reached an all time high of division and disagreement.  I don't know where the individual attended school, but he was ill served as the letter showed a poor understanding of the English language, and a complete failure to grasp the fundamental ideas of the Constitution and the role of government.  He would, however, have been a perfect citizen of Hitler's Germany.

Unfortunately, the writer is not alone in his thinking.  Thanks to an education system which has ignored teaching our founding documents and history, we have a citizenry that is ill-equipped to make rational judgments.  A corrupt, biased media further aids the cause of the left by either under-reporting, selective reporting, or spinning the news to fit their agenda.

Add an apathetic public who prefers cake and circuses over engaging in the workings of government, and you have a recipe for complete disaster.  And that doesn't even count those who depend on the government for the basic necessities of life.

I would remind the writer of the aforementioned letter, that the government was responsible for numerous ills of our Nation's history, including but not limited to slavery, eugenics, interment of the Japanese, the Fugitive Slave Act, and Jim Crow laws.  It was the courage of individual citizens who forced government to change their policies, not the other way around.  So when he attacks those who disagree with the government,  he is putting Martin Luther King in that same esteemed company.

Because of my allegiance to the First Amendment, I may disagree with every word the writer espouses, but I will defend to the death his right to say it.  I doubt, however, that he would allow me the same freedom.

Lost in healhcare.gov glitches:

Obama was looking for company with single-payer expertise

Was President Barack Obama aiming for a tech company well-versed in designing websites for a single-payer health system when he awarded the now glitch-riddled healthcare.gov contract to Canadian CGI?
Behind all the glitches, and at the heart of the utterly stalled healthcare.gov, that’s exactly what CGI is: the Canadian tech firm—Canada’s largest—that has provided to Canada’s single-payer health system.
Is that the dirty little secret hidden behind the public embarrassment that even after spending $93.7 million—a figure expected to double to correct—the Obama administration can’t get healthcare.gov up and running?

“CGI Federal Inc., a subsidiary based in Fairfax, Va., was awarded a US$93.7-million contract over two years ago to help design and develop the federal insurance exchange.”

There’s Nothing Affordable About the Affordable Care Act

A few years ago President Obama appeared on television and told the American public he was going to give them the ultimate free lunch – he said his new Affordable Care Act (ACA) would not only cover 30 million uninsured people, but also reduce the cost of insurance premiums for the typical American family by $2,500. What were we thinking? Was everyone drinking his Kool-Aid?

Now, as we suffer the heat of reality, it is becoming very likely that Americans will be put through extraordinary pains and expense in order to buy a very similar apple for the same price (or more) as an older apple – it will just be called an orange.

This administration and its bought-and-paid-for lawmakers chose to tinker with, and add to, an already complex and teetering framework, rather than to tear it down and build a more sensible and less elaborate structure. The ACA doesn’t really change, but rather tries to reinforce, the basic structure of US health insurance, with its essential reliance for the non-elderly population on employer provided private health insurance. In addition, the ACA system is way too complicated and will take years to be fully operative. (Medicare only took a year to implement.) But the truth is, when has our government ever done anything within the timeframe and for the price they first announced? (If you believe differently, see Kool-Aid in paragraph one).

In addition, experts are announcing that the ACA will not actually reduce administrative costs for the multitude of private insurance companies at all. On top of that, faced with the need to keep premiums as affordable as possible in “the exchanges,” it already appears that the state directors and ACA federal administrators will be under extreme pressure to reduce the benefit package required of all insurers participating in the exchanges. One of the latest articles in Forbes Magazine states that Obamacare will actually increase Healthcare spending for a typical family of four by $7,450. In that same article, it is mentioned that the experts working for Medicare’s actuary have again reported that in its first 10 years, Obamacare will boost health spending by “roughly $621 billion” above the amounts Americans would have spent without this misguided law.

Town Hall Erupts: Why Haven’t You Filed To Impeach Obama Yet?

Congressman Michael Burgess is questioned by a young man, at a town hall meeting, who offers the question all of us are asking “What’s it going to take for you to file Articles of Impeachment?” “I’m a college student, just months away from getting my undergraduate degree.  I like almost everyone here am deeply concerned about the mess and dysfunction of this government – especially with this administration.” Both times this President took his oath of office he swore to preserve, protect and defend the constitution of the United States.  Literally, he has not done so.  He’s broken his oath of office.   President Obama has committed dozens of impeachable offenses…(applause) You, Congressman Burgess, you have also sworn, and I quote, “to support defend the constitution of the United States from all enemies foreign and domestic, and to faithfully discharge the duties of the office.”   In my hand, I have a list of the offenses President Obama has committed for you or for anyone else to see….”

Syrian Rebels Connected to Benghazi Terrorists - CowboyByte

As President Obama prepares to make good on his Syrian “red-line” promise, new information shows the very people a U.S. strike would benefit are connected directly to the same al Qaeda terrorists who attacked the U.S. consulate in Benghazi on 9/11.

U.S. intelligence agencies earlier this month uncovered new evidence that al Qaeda-linked terrorists in Benghazi are training foreign jihadists to fight with Syria’s Islamist rebels, according to U.S. officials. Ansar al-Sharia, the al Qaeda-affiliated militia that U.S. officials say orchestrated the Sept. 11 attacks on the U.S. diplomatic compound and a CIA facility in Benghazi, is running several training camps for jihadists in Benghazi and nearby Darnah, another port city further east, said officials who discussed some details of the camps on condition of anonymity.

Look who’s crashing 9/11 Muslim march

'It seems like a lot of people like to hijack things'

The rapidly expanding grassroots effort to impeach President Obama is now turning its sights on the Million Muslim March planned for Sept. 11.
Although now, the march has undergone a public-relations makeover and the organizers, the American Muslim Political Action Committee (AMPAC), have changed its name to “Million American March Against Fear.”
Fear of what?
AMPAC claims,” Many non-Muslim Americans are terrified of Muslims, who are portrayed by Hollywood and the U.S. media as fanatical terrorists. Muslims, too, live in fear – of being dragged off in the night to Guantanamo and tortured, simply for the crime of being Muslim in the wrong place at the wrong time.”
What bothers James Neighbors, the founder of Overpasses for Obama’s Impeachment, is AMPAC is choosing to make its statement on the very day fanatical Muslim terrorists did indeed kill some 3,000 Americans, on Sept. 11, twelve years ago.
“They could’ve picked any other day of the year. There’s 364 other days of the year they could’ve picked, but the fact they chose 9/11 just simply apppears to be a slap in the face to America and an insult to every American who died in attacks on those days (in 2001 and 2012.)”
“We simply could not tolerate 9/11 being hijacked like that. It seems like a lot of people like to hijack things in this country, like Obama tries to hijack the word patriot for his progressives,” he added.
Overpasses had begun to organize it’s own march on Washington on Sept. 9, dedicated to bring attention to its primary mission, removing President Obama from office.
But founder James Neighbors changed plans and called for a nationwide protest in the streets and on overpasses on Sept. 11. specifically to oppose the Muslim march, after he learned of it.
They won’t be the only protesters, as WND reported a Facebook page has been created dedicated to bringing “2 Million Bikers to DC” to counter the Muslim march.

Dear Black Thugs: You’re Making It Hard For White Devils to Believe You’re Innocent Children

According to the Media, President Obama and the slick-haired Al Sharpton, we white devils are supposed to feel very sorry for the plight of the black teen.

I believe Americans, by and large, do have sympathy for any person or group who’ve had life deal them a bad hand.

However, young black thugs, you’ve got to work with us a little bit because you’re kind of operating against the storyline the aforementioned are singing about y’all, and thus, making it difficult for us to soulfully commiserate.

Of what, pray tell, do I speak?

‘WHO IS LEADING US?’: GLENN BECK’S SCATHING CRITIQUE OF OBAMA’S ‘DIVISIVE’ LEADERSHIP

Glenn Beck asked three simple questions of his audience on Thursday: Who is leading us? What do they believe? And where are they taking us?

In determining the answers, Beck paid particular attention to the difference between actions and words, analyzing a number of news stories of the day.
“[President Obama] can give speech after speech about people coming together, but if he’s not living that, if that’s not his attitude…it doesn’t work,” he said.
Beck highlighted a number of stories into which the president has “injected” himself, while noting his silence on “other divisive stories where there’s a real chance to unite people.”
Note the difference between the president’s heartfelt comments on the Trayvon Martin case, and his silence on the Christopher Lane case, Beck said.

“I’m watching my commander-in-chief and I’m wondering – why doesn’t he care about this case?Beck asked.  “Does he really care about equal justice, or justice sometimes, for the right people?  Is the president really concerned about racism, as he claims he is, or is he only concerned about racism sometimes, with some people?”
“You can make your own decision, but here’s the real question — what are his actions teaching people?” Beck added.  “Where is he leading us?  What is he building?”
In Beck’s opinion, the president is “building a society that says justice is not blind” and “equal justice no longer exists.”
When the president’s actions do line up with his words, Beck said the insight is “breathtaking.”
“[The president] spoke flowingly during the Arab Spring, and his administration supported the Muslim Brotherhood vocally, and their actions met their words — and when that happens, they’re rarely pro-America,” Beck said.

Regulation nation: Obama expands the regulatory state - The Hill's RegWatch

President Obama has overseen a dramatic expansion of the regulatory state that will outlast his time in the White House.

The reach of the executive branch has advanced steadily on his watch, further solidifying the power of bureaucrats who churn out regulations that touch nearly every aspect of American life and business.

Experts debate whether federal rulemaking has accelerated under Obama, but few dispute that Washington — for better or worse — is reaching deeper than ever before into the workings of society.

“It would be difficult for anyone to pretend that this isn’t a high water mark in terms of regulation,” said Douglas Holtz-Eakin, a former director of the nonpartisan Congressional Budget Office who now heads the American Action Forum.

Obama famously signaled his intent to use the machinery of government to further his policy goals after the 2010 elections, declaring: “Where Congress won’t act, I will.”

Since then, the administration has pressed ahead unilaterally on several fronts, including immigration, gun control, cyber security and sentencing guidelines for drug offenses.

Meanwhile, new federal rules are accumulating faster than outdated ones are removed, resulting in a steady increase in the number of federal mandates.

Data collected by researchers at George Mason University’s Mercatus Center shows that the Code of Federal Regulations, where all rules and regulations are detailed, has ballooned from 71,224 pages in 1975 to 174,545 pages last year.

“All incentives are to regulate more,” said Susan Dudley, the director of George Washington University’s Regulatory Studies Center.

The fight over executive power is increasingly pitting the three branches of government against each other, with Congress and the judiciary struggling to assert power over officials with broad discretion to issue rules.

While Republican lawmakers have scored victories in the messaging battle over regulations, they say proponents of a more activist government are winning the war.

“We sit back and watch this erosion and watch, really, an executive branch that has, I think, arrogant powers of overseeing things,” Rep. Mike Kelly (R-Pa.) told The Hill.

Taken separately, the public tends to support individual regulations.

A Gallup poll earlier this year found that 82 percent of Americans either believe the government is doing the right amount or needs to do more to protect the environment, while two-thirds say they would support stricter standards for food sold in public schools.

But critics, including industry groups and congressional Republicans, charge that the cumulative affect of the mounting red tape is crushing businesses.

“All the kinds of things we say we want: an expanding economy, more opportunity, more jobs — all of them are stifled by the regulatory oppression that’s occurred,” said Rep. Tom Price (R-Ga.).

Obama has responded to business’s concerns with a regulatory “look-back” aimed at scrapping old rules on the books. Howard Shelanski, the administration’s regulatory chief, told Congress last month that the effort had turned up hundreds of regulatory reform proposals, just a few of which could save up to $10 billion.

But the process of getting rid of regulations is easier said than done, experts say.

GOP Rep. says Obama has founding fathers 'turning over in their graves' - The Hill's Blog Briefing Room

Rep. Michael Grimm (R-N.Y.) said recent executive actions by President Obama, including a plan to extend high-speed Internet connections to virtually every school in the nation, demonstrate a "blatant" attempt to subvert the will of the American people.

"It's just a flagrant, you know, arrogant disregard not just for the current Congress," Grimm said in an interview with Fox News. "Look, it's not about me personally. That's not what this is about. You think about who is the Congress? It really — it is the voice of the people."
Obama has asked the  Federal Communications Commission to hike a telecommunications fee to help pay for the ConnectEd program, which is estimated to cost between $4 billion and $6 billion. According to The Washington Post, that could translate into an increase of about $12 spread over three years in cell phone users' bills.

What Everybody Ought to Know About Obamacare

Obamacare: It’s unfair, unaffordable, and unworkable.

So it’s no surprise that Organizing for Action, President Obama’s campaign group, isaggressively posting on all of its media outlets to try to hide the truth about Obamacare.
Just last week, the group blasted out emails and tweets to activists encouraging them to “see how Obamacare is already working.”

But Organizing for Action is wrong. Obamacare isn’t working, and it won’t ever work. That’s why we’re challenging every claim Obamacare supporters make—and you should, too. Congress should refuse to spend a single dime implementing this massive train wreck.
Check out the infographic below and learn how Obamacare is not working.
