The Obama administration’s proposed crackdown on tea party and other nonprofit groups that want to play a role in politics is quietly crumbling as opposition builds across the political spectrum to new IRS rules.

Almost all of the nearly 70,000 public comments submitted as of Monday night were vehemently opposed to the proposal, which would limit the ability of social welfare nonprofits — those organized under 501(c)(4) of the tax code — to even talk about candidates in the two months before an election.

1. Legal Taking of Private Property

Hotze v. Sebelius challenges the constitutionality of the employer mandate. The Fifth Amendment prohibits the government from taking private property for public use without “just compensation.” Steve Hotze, a doctor in Texas, is arguing that Obamacare violates this “takings clause” by mandating that his business give money to another business, specifically an insurance company, without any compensation.

The Obama administration has issued new exemptions to a law that bars certain asylum-seekers and refugees who provided “limited material support” to terrorists who are believed to pose no threat from the U.S.

The Department of Homeland Security and the State Department published the new exemptions Wednesday in the Federal Register to narrow a ban in the Immigration and Nationality Act excluding refugees and asylum seekers who had provided limited material support, no matter how minor, to terrorists.

Obama to waive terror prevention laws to import thousands of Syrian Muslims to U.S.

U.S. plans to resettle thousands of Syrians displaced by their country’s civil war could hinge on those refugees receiving exemptions from laws aimed at preventing terrorists from entering the country.

A U.S. official stated publicly for the first time this week that some of the 30,000 especially vulnerable Syrians the United Nations hopes to resettle by the end of 2014 will be referred to the U.S. for resettlement.

Study: Obama’s proposed minimum wage hike could destroy 1 million jobs

The Obama administration’s proposal to raise the minimum wage to $10.10 an hour could result in as many 1,084,000 jobs eliminated from the work force class, according to a new study conducted by the Employment Policies Institute (EPI)

“No amount of denial by the president and his political allies — and no number of ‘studies’ published by biased researchers — can change the fact that minimum wage hikes eliminate jobs for low-skill and entry-level employees. Non-partisan economists have agreed on this consensus for decades, and the laws of economics haven’t changed,” Michael Saltsman, research director at EPI, said in a statement.

Proposed Medicare drug change stirs access worries

WASHINGTON — In a move that some fear could compromise care for Medicare recipients, the Obama administration is proposing to remove special protections that guarantee seniors access to a wide selection of three types of drugs.

The three classes of drugs — widely used antidepressants, antipsychotics and drugs that suppress the immune system to prevent the rejection of a transplanted organ — have enjoyed special "protected" status since the launch of the Medicare prescription benefit in 2006.

That has meant that the private insurance plans that deliver prescription benefits to seniors and disabled beneficiaries must cover "all or substantially all" medications in the class, allowing the broadest possible access. The plans can charge more for costlier drugs, but they can't just close their lists of approved drugs, or formularies, to protected medications.

IRS to get 'license to kill' groups that oppose Obama agenda

The Washington Times, January 7, 2014 — The Internal Revenue Service is getting a special new power: a “license to kill” group that oppose the Obama agenda. James Bond’s license to kill isn’t nearly as broad.

The power to tax is the power to destroy. Its new powers will let the IRS destroy certain groups, especially those connected to the Tea Party, by imposing a tax on their work and messages during campaign seasons. Even the value of volunteer work could be taxed.

Suspicion traces the plan directly to President Barack Obama, since he personally met with IRS chief counsel William Wilkins — an Obama political appointee and long-time supporter — in the Roosevelt Room of the White House on April 23, 2012, two days before the IRS issued its key internal directives to target Tea Party and other conservative groups.

Now, unless Congress acts quickly to block them, new IRS regulations will deliver a death penalty to many of almost 100,000 grass-roots non-profits known as 501(c)(4) groups. They often provide information to the public about political issues, befitting their tax requirement to benefit social welfare.

The IRS wants to create a new bureaucratic definition that re-labels those common voter information activities by re-naming them “candidate-related political activity.” For short, IRS calls it CRPA, but CRAP would fit better.

This is actually a gag rule. But the IRS’s new speech restrictions do not apply to labor unions, trade associations, political parties, or other non-profit groups such as 501(c)(3)’s. The impact is limited to the 501(c)(4)’s, which are the favorite vehicle for Tea Party groups.

The Left also has 501(c)(4) non-profits which could be muzzled by the new rules. But the Obama Administration is notorious for selective enforcement, meaning it could choose to give a pass to friendly groups while it puts conservatives out of business. They could use this in efforts to shut down groups like the Faith and Freedom Coalition, Club for Growth, Americans for Prosperity and the National Rifle Association, while ignoring People for the American Way, American Civil Liberties Union, USAction and the Democratic Leadership Council.

News from The Hill: White House unveils new gun control effort

The Obama administration on Friday announced a new set of actions designed to keep weapons from the mentally ill, declaring once again that the president is intent on using his executive authority to pursue tighter federal gun control in lieu of congressional action.

The plan includes two proposed regulations designed to clarify who may possess guns and shore up a woefully porous national background check system.

“Too many Americans have been severely injured or lost their lives as a result of gun violence,” the White House said upon announcing the initiative. “While the vast majority of Americans who experience a mental illness are not violent, in some cases when persons with a mental illness do not receive the treatment they need, the result can be tragedies such as homicide or suicide.”

The Year of ObamaCare--Here Comes the ObamaCare Tax Avalanche!

As of January 1,  ObamaCare is the law of the land. Or more accurately, those parts of ObamaCare that weren’t unilaterally changed or delayed to serve the interests of the Obama administration and the Democratic Party heading in the 2014 election.

Despite those efforts, it would appear that 2014 will bring no respite from the criticism associated with what might be best described as the biggest government boondoggle of all time. As the nation straddles the passage from the old year into the new, the hits just keep on coming.

The first hit concerns the exchanges themselves. As Forbes Magazine contributor Michael Cannon explains, ObamaCare enrollments remain a whopping 60 percent below the targets set by the Obama administration. Only 2.2 million Americans out of the 3.3 million envisioned by the administration have signed up, not paid up. That means the 2.2 million figure will eventually be lower, since no program has a 100 percent success rate in that regard. Thus the administration’s notion that they can meet their target of 7 million paying customers by March 31 (of which 2.7 million must be “young invincibles” to offset the costlier coverage for older, sicker Americans) looks like a pipe dream. Furthermore, since the 60 percent number is a national average, states with low enrollment totals will undoubtedly see a surge in premium costs by 2015.

$11 Mil for Equipment to Make Healthier School Meals for Poor Kids

To meet the requirements of Michelle Obama’s multi-billion-dollar childhood obesity law, her husband’s administration is dedicating $11 million so public schools can buy kitchen equipment to prepare healthier meals for low-income students.

It’s simply the latest of many generous allocations to help attain the Obama family goal of conquering childhood obesity, especially in minority and inner-city neighborhoods. Just a few weeks ago the administration awarded a $1.2 million government grant to help middle school students create fitness video games known as “exergames.” The administration has also spent hundreds of millions of dollars, according to its own records, to study obesity and justify the creation of restrictive policies to control what Americans eat.

Obama Administration Secretly Extends Health Care Enrollment Deadline

The Obama administration has decided once again to make adjustments to the Affordable Care Act, secretly extending the deadline for enrollment by one day.

 

Midnight on Dec. 23 (Monday) was the original cut off date for enrollment for people who want coverage starting January 1. But without so much as a formal announcement, consumers will now have until midnight on Tuesday to enroll in Obamacare, the Washington Post reported, citing two officials who are familiar with the situation.

Who Says Obama Hasn’t United the Country?

Yesterday the Obama administration suddenly moved to allow hundreds of thousands of people who’ve lost their insurance due to Obamacare to sign up for bare-bone “catastrophic” plans. It’s at least the 14th unilateral change to Obamacare that’s been made without consulting Congress. 

“It shows that the Obamacare insurance products aren’t selling so, at the last minute, the administration is holding a fire sale on a failed launch,” says Grace-Marie Turner of the Galen Institute, a health-care advocacy group. “Just think how you must feel if you were one of the people who spent the last two months fighting their way through HealthCare.gov to buy a policy that will be thousands of dollars more expensive than this catastrophic insurance!”

In the same way Obamacare was foisted on America by creating a 2,000-page law that Democrats in Congress never even bothered to read, a new treaty about trade with Asia is going through the same process and poses as great, if not greater, threat to our economy, our judiciary, and our sovereignty.  Secrecy and outright deception is the hallmark of the Obama administration and a proposed Asian treaty must be stopped. 

It is the Trans-Pacific Partnership (TPP) and, writing on The Economic Collapse blog, Michael Snyder, notes that “This treaty has 29 chapters, but only 5 of them have to do with trade. Most Americans don’t realize this, but this treaty will fundamentally change our laws regarding internet freedom, health care, the trading of derivatives, copyright issues, food safety, environmental standards, civil liberties, and so much more.”

Snyder warns that “It contains a whole host of things that Obama would be unable to get through Congress on his own. But he is hoping to spring this on Congress at the last minute and get them to agree to this ‘free trade agreement’ before they realize all of the things contained in it.” This is a definition of governing by deception. It evokes the way Obamacare was put before a Congress that had not read it…and which passed by a straight party-line vote by Democrats.

White House delayed enacting rules ahead of 2012 election to avoid controversy

The White House systematically delayed enacting a series of rules on the environment, worker safety and health care to prevent them from becoming points of contention before the 2012 election, according to documents and interviews with current and former administration officials.

Some agency officials were instructed to hold off submitting proposals to the White House for up to a year to ensure that they would not be issued before voters went to the polls, the current and former officials said.

The delays meant that rules were postponed or never issued. The stalled regulations included crucial elements of the Affordable Care Act, what bodies of water deserved federal protection, pollution controls for industrial boilers and limits on dangerous silica exposure in the workplace.

 

The Obama administration has repeatedly said that any delays until after the electionwere coincidental and that such decisions were made without regard to politics. But seven current and former administration officials told The Washington Post that the motives behind many of the delays were clearly political, as Obama’s top aides focused on avoiding controversy before his reelection.
