Follow-Up: Is the New VA Requirement for Disabled Vets Illegal?

An update this morning on a story that Fox News legal analyst Peter Johnson Jr. brought to you yesterday, in which he detailed a new red tape proposal by the Department of Veterans Affairs.

Even as the backlog of unpaid claims reaches 685,000, the administration wants veterans - some of whom are homeless or have suffered severe injuries - to be required to submit their disability claim electronically using a new standardized form.



This is a horrible way to treat our brave warriors!  Time for us to make some noise, please!

Michelle Malkin: Remembering Pearl Harbor: 72 years

On Saturday, the two oldest veterans in America — a pair of 107-year-olds who fought in the Pacific theater 70 years ago — will meet up to mark the anniversary of the attack on Pearl Harbor and to trade stories.

It’s a heartwarming photo op, but also a sign of the nation’s fading ties to the Greatest Generation and a warning to the Sept. 11 generation that the mantra of “never forget” grows more difficult as the years pass.

Veterans Wait Years For Benefits While VA Employees Get Bonuses For Inept Work | Godfather Politics

If you are a veteran, have you run into difficulty getting your benefits from the Veterans Administration?  I read about a number of veterans that waited a year or more to receive needed benefits including medical treatment.  Men and women who served our nation only to get wounded and maimed end up waiting months to receive their desperately needed disability compensation.  There are horror stories across the nation of men and women who almost qualify as a marathon runner from all of the run arounds they get from the VA. 

Perhaps that’s because VA employees can no longer earn points for following up on contacts and perusing whatever documents are necessary to process a case.  This was known as ‘supplemental development’ and they used to gain extra points for this, but that is no longer the policy.  With no reward or incentive to go beyond the minimum requirements, resulting in poor performance, many claims are being handled improperly or left incomplete.  At the moment, the VA reports that there are about 14,000 veterans who have appeals still pending after more than 2 years of applying for their rightful benefits.

In fact, the employees earn points for normal minimal processing of claims.  According to one VA employee, this results in many workers concentrating on pushing through the easy claims and even cheating on claim processing at times.  At the same time, they ignore the harder backlogged claims because they don’t earn any points towards their bonus if they do.  Hence, thousands of wounded veterans are facing medical, financial, employment and even family problems because VA workers opt not to work on their claims. 

The VA is so inefficient that last year, they closed their Oakland office for a time in order to retrain their employees because they were so inept at their jobs.  The VA office in Baltimore is the worst in the nation as it takes longer for them to process a claim than any other VA office in the nation. 

Yet, 90% of the employees at the Oakland VA office and 40% of the workers at the Baltimore office received bonuses for their outstanding performance.  In contrast, the VA office in Sioux Falls has a performance record more than 4 times better than the Oakland office, but less than 10% of their staff received bonuses. 

All toll, certain VA employees shared in $5.5 million worth of bonuses.  However, it seems that the more inefficient the employees were, the more of them that shared the bonus.  If I were in charge of the Veterans Administration, I would completely revamp the point system and bonus program to insure that only those employees who are doing their jobs to the best of their ability will get bonuses.

Please do not be fooled! Obama care is harmful to Americans health. It will transfer ALL medicare patients under 133% of poverty level off Medicare which they paid for when they worked and switch them to Medicaid which will let you die if you have cancer or another catasrophic ilness.


All Veterans on VA health care based on need will also be transferred to medicaid. The forces that crafted this law are dark. It was Tom Daschel's brainchild to slip into another spending bill unoticed and pass a law that will limit coverage of sicknesses that are still present today so the Pharmacutical industry can slow down on research and development, expected to slow down the rising costs of prescriptions. And this bill is designed to get Americans to come to he understanding that we should be prepared to die with illnesses that are currently treated because with the baby boom generation getting old and retiring. Spending per patient at the current level will bankrupt America. They want us to accept death with age like they have done in Europe. hundreds of thousands of people throughout Europe are euthanized each year.


The most money per patient will be spent on people between the ages of 15 and 50. Sarah Palins son may not have survived under this bill. Because this legistlation forces self paid insurance to conform to the intent of the law. This makes private insurance conform closer to medicaid rules. The bill cites that the most money 80% will be spent during the last 5 years of life and seeks to control it. Raum Emmanuel's brother was working with the hhs during writing this bill and said that it was a good thing because they could save some money and spend some of the savings on a worthy goal such as the arts. The arts are more important than your life.

The left did not get away with this unoticed because of the Tea Party and other freedom groups spread the word that the heart of this legistlation was not what it appeared to be.

But we still have work to do. We need to turn the executive and both legistative branches of Congress to elect conservatives that will repeal this law in November or the America we know will be changed forever.

FL Dems Fly American Flag With Obama’s Face on It — Vets Outraged

An American flag featuring an image of President Barack Obama’s face was removed from outside a local Florida Democratic Party headquarters Tuesday after several veterans called it “despicable” and a “desecration,” the Orlando Sentinel reported.


Veterans gathered Tuesday afternoon to protest in front of the Lake County Democratic Party headquarters, where the flag — featuring Obama’s face in the blue section where the stars normally go — was flying beneath a traditional American flag. The confrontation ended after party chairwoman Nancy Hurlbert took the flag down, according to the Sentinel.

Votes this Week: STOCK Act


Our country is facing a grave economic crisis, unemployment is rampant and continues to rise, and our country is further in debt than ever before. Unfortunately, Congress seems unwilling to tackle these pressing, vital issues. The American people are counting on the federal government to pass legislation that will improve our economy and create jobs, and Washington should be voting on policies that will attract capital and get investors off the sidelines so they can create jobs and spur growth.

Much to my dismay, however, the Senate has spent the greater part of this week debating the STOCK Act, a law that would codify what existing law already says. I voted against this bill because it goes without saying that laws regarding insider trading that apply to the American people also apply to members of Congress and their staff. Members of Congress are elected to serve the people, not make money for themselves, and any Member or staff member who breaks the already existing insider trading laws should be held responsible. Rather than wasting time codifying laws that already exist, Washington should take up real legislation focused on what’s most important to American citizens – jobs and the economy. (Mmmmm..not sure I buy that Senator, were they not 'exempt'?)

Honest Budget Act: Restoring Accountability in Spending

Instead of tackling our economic crisis head on and instituting job-creating policies that restore certainty and predictability, Washington continues to throw money at the problem. Continued levels of high unemployment have shown that this pattern of egregious spending and expanded government have failed and are worsening our current crisis. Our economy is suffering, and now we have record-level debt on top of it.

Washington must learn to live within its means, and this starts with passing an annual budget to fund the federal government. It has been over 1,000 days since Senate Democrats passed a budget, and without one we have no blueprint for our nation’s spending priorities. (1010 to be exact!)

Last fall, I cosponsored the Honest Budget Act which would help restore honesty and accountability in government spending by putting an end to budget gimmicks that make it easier for Washington to spend money it does not have. On Wednesday, my colleagues in the House of Representatives introduced their version of this bill. We owe it to our nation’s taxpayers to govern responsibly and be transparent about how their hard earned dollars are being spent, and this legislation to eliminate dishonesty in the budget process is a step in the right direction.


Keystone XL Pipeline: Energy Security & Job Creation

In another effort to turn our economy around, on Monday I joined 43 other Senators in introducing a bill to continue construction on the Keystone XL pipeline, a project that would take great steps towards improving our energy security as well as create jobs for thousands of American workers. Despite claims that promoting energy security and creating jobs are top priorities, President Obama rejected the permit for the Keystone XL pipeline earlier this month.

Rather than support a project with the potential to create thousands of jobs for American citizens, while also increasing energy supplies from friendly neighbors, the President continues to place politics over policy. Since the President has failed to lead on the issue, our bill would authorize construction on this project under the Commerce Clause of the U.S. Constitution. Caring for the Victims of Water Contamination at Camp Lejeune

Those of you who are regular readers of this newsletter are well aware of the decades of water contamination at Camp Lejeune that caused many of the Marines, sailors, and their family members who lived or worked on base to become sick, and in some cases die, with various forms of cancer as a result of their exposure to this toxic water. Recently, the U.S. Marine Corps asked the Agency for Toxic Substances and Disease Registry (ATSDR) to remove parts of its recent study on this issue citing national security concerns. The information they wanted removed has been publicly available for several years, and it is unclear why it suddenly became a security threat and had to be removed from the report.

I fear that removing this information may jeopardize ongoing and future studies of the water contamination at Camp Lejeune, and also worry that this sets a dangerous precedent of withholding information from scientific studies for reasons of national security without adequate legal justification. Last week, I sent a letter to the Director of the Centers for Disease Control and Prevention (CDC), along with Senators Hagan (D-NC), Rubio (R-FL), and Nelson (D-FL) and Congressmen Miller (D-NC) and Dingell (D-MI), asking him to look into the legal soundness of the USMC’s request to redact this previously public information. The men and women of the Camp Lejeune community were sacrificing for our country when they were exposed to harmful chemicals without their knowledge, and we owe it to them to continue investigating how they were affected, spur greater health awareness, and provide them the compensation and care they deserve. Making Veterans’ Court of Appeals More Efficient for Veterans

Also this week, I introduced a bill that would require all judges of the U.S. Court of Appeals for Veterans Claims to reside within 50 miles of Washington, D.C., in order to increase the overall efficiency and effectiveness of the Court. It is no secret that things tend to run more smoothly when those people integral to the day-to-day operations of the Court are present, and if Veterans Court judges have to travel across the country to get to their offices, it could make it extremely difficult for them to fully engage in their case work, manage their staff, and carry out their judicial functions. Our nation’s veterans could suffer from these inefficiencies. By requiring judges to live near the court’s office, we can help ensure that veterans receive the timely decisions from the Court that they deserve and we can keep down costs that result from judges working remotely and regularly traveling to and from Washington.

March for Life

Finally, last week I had the pleasure of meeting with hundreds of North Carolinians who traveled to Washington to take part in the March for Life. VETERAN DENIED USE OF PUBLIC LIBRARY TO TEACH CONSTITUTION

Patriots, Veterans, Oath Keepers, and ALL Defenders of the Bill of Rights and the Constitution, (especially those in KANSAS),

The Constitution and Bill of Rights are under attack more and more with each passing day. Yesterday, Patriot Coalition general counsel Richard D. Fry invited me into his office to witness a conversation he was having with veteran defender and "Wounded Warrior Project" supporter Roger Ewing of Hays, Kansas.

The Hays Public Library in Hays, Kansas is refusing to allow Roger Ewing of Big First Tea Party, (a member of Tea Party Patriots), the use of taxpayer-funded facilities at the Hays Public Library to teach the Constitution, and is yet another example of the ongoing "intolerable acts" our nation is suffering at the hands of bureaucrats. It seemed almost Orwellian when I first heard of the runaround Mr. Ewing received, including a requirement by the Hays Public Library to "bring in the material" he planned to use for their "prior approval," in direct violation of library policy.

Mr. Ewing's attorney, Patriot Coalition general counsel and constitutional attorney Richard D. Fry is looking into possible legal action against the Hays Public Library, and its leadership. The Hays City Commission's next meeting is: THURSDAY, JANUARY 19, 2012 – 6:30 P.M.

What I find even more outrageous is that the Hays Public Library Board "denied" his request, not once, but repeatedly, as they were apparently offended that he belonged to a tea party, and intended to use the National Center for Constitutional Studies' "Making of America, The Substance and Meaning of the Constitution" textbook written by Cleon Skousen, author of "The 5,000 Year Leap."

While there are many organizations that produce educational material on the U.S. Constitution, and the founding of our nation, there are none that the Patriot Coalition and many of its partners across the country hold in higher regard than the National Center for Constitutional Studies.

I was outraged this afternoon when I heard the conversation between you, Roger Ewing, and Hays, Kansas city attorney John Bird.

"It is our property. We get to do what we want with it," said John Bird, city attorney for the town of Hays, Kansas in a phone conversation with Mr. Ewing's attorney Richard D. Fry, Tuesday afternoon, Jan. 17, 2012. Mr. Bird continued, "If you have the money for a lawsuit, go for it."

Mr. Bird, the Hays Public Library is NOT your property, but belongs to the citizens of Hays, Kansas. I was amazed that even after Mr. Fry informed Hays Public Library staff and Hays City Attorney John Bird that their policy was a violation of the library's official policy, and an infringement on Mr. Ewing's 1st Amendment Rights, that they not only remained unmoved, but indifferent to his concerns, repeatedly referring to Mr. Ewing's group as a "political party."

Attached is the Hays Public Library's official policy in PDF form, which conflicts with the Hays Public Library's treatment of Mr. Ewing in "every conceivable way," as per library policy, and Kansas state law. I have highlighted numerous areas in their policy documents that illustrate the absurdity of their actions.

According to the Hays Public Library Policy, (in accordance with Kansas State law), Mayor Barbara Wasinger not only appoints all board members, but is a member herself with all the same voting privileges as the rest of the board. The citizens of Hays, Kansas should strongly consider whether Mayor Wasinger has chosen the right people for the Hays Public Library Board, as well as their choice in city attorney. The total disinterest, arrogance, and contempt for its own veteran citizens warrants cleaning house come election time.

If Hays, Kansas Mayor Wasinger will not address this matter post-haste, she too should be voted out of office. I can't think of very many duties of any taxpayer-funded public institution than to be supportive of veterans teaching the U.S. Constitution. Concerned citizens are encouraged to attend and respectfully express their opinions to the Hays City Commissioners at their next meeting, which is this Thursday, January 19, 2012, at 6:30p.m.

Hays Public Library more than likely receives federal, state, and local taxpayer funding. I would encourage everyone to reach out to Rep. Tim Huelskamp, who represents Kansas' 1st Congressional District to find out if federal tax dollars are funding a public library that is refusing a veteran the use of taxpayer-funded facilities to teach the Constitution. The Big First Tea Party's original event date, scheduled for tomorrow, has been moved to Thirsty's Brew Pub and Grill, 2704 Vine St., Hays, Kansas. As Patriot Coalition National Director, and a Gulf War veteran myself, I am calling on all veterans, tea party members, Oath Keepers, minutemen, and ALL defenders of the Constitution to join us in Hays, Kansas tonight, and to let everyone up and down the political food chain know that you stand with Mr. Ewing, and the Big First Tea Party.

Vet’s Grassroots Club Denied Access to Public Library To Teach Constitution:
First Amendment Hangs in the Balance

Roger Ewing, the leader of the Big First Tea Party in Hays Kansas, was denied access again today (1/17/12) to a public meeting room at the Hays Public Library. Mr. Ewing has been trying to gain access to the library for over a month.

Initially Mr. Ewing was told that since the Big First Tea Party was a political party the Library policy is to deny them access to the public meeting rooms. Mr. Ewing told the library Director that the Big First Tea Party was a non-partisan grassroots citizens’ organization. None the less, due to their political orientation the Big First Tea Party was denied access.

Mr. Ewing notes the Library has allowed political candidates and office holders to have public meeting at the Library.

Mr. Ewing was attempting to find a location to teach the Constitution of the United States. Library staff required him to bring in the educational material for their review. Even after their review of the material, the Making of America Constitution class material of the National Center for Constitutional Studies, the Five Thousand Year Leap people, the library staff found the material to be too political.

Today Mr. Ewing again approached the Hays Public Library for access to teach the United States Constitution and to hold a public explanation of and discussion on the National Defense Authorization Act (NDAA). When it was pointed out that the Library’s policy did not prohibit the teaching of the U.S. Constitution or to have an educational seminar and public debate on federal law he was told they had “precedents”.

Although he was finally allowed to speak to the Library Director, Eric Norris, and some of the board members he was refused access and referred to the City Attorney, John Bird. Mr. Bird indicated that “it’s [the library] our property and we get to do what we want with it”. Mr. Bird also referred to the library’s policy and “precedents”.

North Carolina Legislative Report November 18, 2011

U.S. Congress

1. Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2012 (H.R. 2112) - The $128 billion bill appropriates funds to the select agencies for the remainder of 2012. Conservative Republicans opposed the bill's price tag and other provisions. The funding averts a shutdown of the agencies cited, and has to be signed by midnight Nov 18, 2011. Since President Obama is in Indonesia, "a machine imprint of his signature" will be used. (The Wall Street Journal)

In an article on RedState.com, Daniel Horowitz wrote that the bill ". . . contains record levels of spending for Food Stamps, WIC, and international food aid. It also contains $2.3 billion for disaster spending , which is excluded from the budget caps. Further, the "bill has a provision which was inserted into the conference report to expand the role of Fannie Mae and Freddi Mac."


In the Senate, the vote on Nov 17, 2011 was 70 to 30 with Senator Burr voting against it and Senator Hagan voting for it.

The House also voted on Nov 17, 2011 to pass the bill in a vote of 298 to 121 with 14 not voting.

NC Representatives voting for the bill: G. K. Butterfield (D-1st), Renee Ellmers (R-2nd), David E. Price (D-4th), Howard Coble (R-6th), Mike McIntyre (D-7th), Larry Kissell (D-8th), Heath Shuler (D-11th), Melvin Watt (D-12th), and Brad Miller (D-13th)

NC Representatives voting against the bill: Walter B. Jones (R-3rd), Virginia Foxx (R-5th), Sue Myrick (R-9th), and Patrick T. McHenry (R-10th).

2. Government Contract Withholding Repeal Act (H.R. 674) - On Nov 10, 2011 the Senate voted to amend the Tax Code "to repeal a requirement that government agencies withhold 3 percent of payments to government contractors," and to "give tax credits to companies that hire unemployed veterans." (Megavote) In addition, the bill "Includes social security benefits that are excluded from gross income in the calculation of modified adjusted gross income for purposes of determining eligibility for the tax credit for coverage under a qualified health plan." (Bill Summary)

The Senate vote was 95 to 0 with 1 voting present and 4 not voting. Senator Burr voted for it and Senator Hagan did not vote.

On Nov 16, 2011 the House voted on the same bill and the vote was 422 to 0 with 11 not voting.  All NC Representatives voted for the bill.

House - Other Recent Votes

National Right-to-Carry Reciprocity Act of 2011 (H.R. 822) - The bill "Amends the federal criminal code to authorize a person who is carrying a government-issued photographic identification document and a valid permit to carry a concealed firearm in one state, and who is not prohibited from possessing, transporting, shipping, or receiving a firearm under federal law, to carry a concealed handgun (other than a machinegun or destructive device) in another state in accordance with the restrictions of that state." (Bill Summary)

On Nov 16, 2011 the bill passed in a vote of 272 to 154 with 7 not voting.  NC Representatives voting for the bill: Renee Ellmers (R-2nd), Walter B. Jones (R-3rd), Virginia Foxx (R-5th), Howard Coble (R-6th), Mike McIntyre (D-7th), Larry Kissell (D-8th), Sue Myrick (R-9th), Patrick T. McHenry (R-10th), and Heath Shuler (D-11th).

NC Representatives voting against the bill: G.K. Butterfield (D-1st), David E. Price (D-4th), Melvin Watt (D-12th), and Brad Miller (D-13th).

Defense

1. In September the Obama Administration presented its plan to cut the deficit and identified $27 billion in cuts from the military healthcare program involving changes in TRICARE health and pharmacy benefits, along with changes in the retirement system, and other restructuring ideas. (Military Officer Association of America (MOAA))


2. Super Committee (Joint Select Committee on Deficit Reduction) - Their report is due on Nov 23, 2011 that will cut the budget deficit by a minimum of $1.2 trillion and if the committee cannot agree, automatic cuts of $1.2 trillion will take place in January 2013 (KICKING THE CAN DOWN THE ROAD AGAIN) affecting only Defense and Medicare. The Hill has reported that "Republicans are especially fearful" of cuts to defense. A Democrat aide said, "Members would prefer to live with a stalemate than an unbalanced deal that is surrender to the Republicans, and that attitude is reflected in the leadership."

3. Caring For Camp Lejeune Veterans (S 277) - Senator Burr has sponsored this bill which has two parts:

• It provides hospital care and health benefits to veterans and their families who were stationed at Camp Lejeune while there was a contaminated water problem.

• The bill also "Requires the DOD Secretary to merge and consolidate all commissary and exchange stores into a single system that, by not later than the end of FY2015, operates on a self-sufficient basis without the need for financial support through appropriated funds. Prohibits any DOD funds from being obligated or expended after FY2015 for commissary and exchange stores." (Bill Summary)

The bill has been placed on the Senate Legislative Calendar, but no date is identified for the vote.

For over 20 years lobbyists from the supermarkets and retail establishments have fought against the commissary and the exchange. (The Ft. Bragg Commissary advertises at the door that the commissary is the number one benefit to the military).

1. The General Assembly will convene for a special session Nov 27- 29, 2011. 2. Another bill receiving much attention is the "Cap Motor Fuel Excise Tax Rate" (House Bill 399). " "North Carolina now has the third-highest gas tax in the United States," according to a report in the Charlotte Business Journal. "North Carolina's tax of 35 cents a gallon ranks only behind Washington (37.5 cents) and California (35.7 cents)" for a gallon for gas. The nation's lowest rate is Georgia at 7.5 cents a gallon. (Charlotte Observer)

The General Assembly to date has not addressed the Democrat sponsored bill that automatically recalculates the gas tax every July 1 and Jan 1.

Representative John Blust (Guilford), one of the cosponsors of the bill, has provided the following Resolution:

"RESOLUTION OF THE NORTH CAROLINA REPUBLICAN PARTY

WHEREAS, North Carolina has a tax on gasoline of 35 cents per gallon, the third highest of any state in America, and


WHEREAS, the Democrats, when they controlled the North Carolina legislature, put in place a formula that enables the gas tax to rise automatically as the wholesale price of gasoline rises on the market without the legislature having to take a vote to raise the gas tax, so that legislators can escape accountability for gas tax increases, and


WHEREAS, these same scheming politicians also put a floor on the gasoline tax so that it cannot fall below a certain level if the wholesale price of gasoline declines, and

WHEREAS, Republicans took control of both the North Carolina House and the North Carolina Senate for the first time since reconstruction in the 2010 elections, due largely to the resources, time, efforts and other contributions of grassroots Republican activists across the state of North Carolina, and

WHEREAS, Republican candidates for the North Carolina House, North Carolina Senate, US House and US Senate campaigned on a similar theme that they would get runaway spending under control and put the state and nation on a sound fiscal footing without raising taxes, and this message of fiscal responsibility resonated with an electorate that believes it is taxed enough already in a very difficult economy, and

WHEREAS, the Obama administration and liberal Democrats in Congress, led by Speaker Nancy Pelosi and Senator Harry Reid, enacted a wasteful stimulus bill, claiming that spending billions of dollars more money on infrastructure and "shovel-ready projects" would turn the economy around and create millions of new jobs,


WHEREAS, the Obama stimulus and other irresponsible spending has actually choked economic growth, impeded job creation, retarded any economic recovery, and has been an all-around abject failure, and


WHEREAS, Obama, Reid and Pelosi have lately been demanding a second stimulus, again based upon the already failed argument that raising taxes and spending billions more on infrastructure will lead to economic growth and job creation, and

WHEREAS, the price of gasoline has risen considerably over the last two years as the anti-energy policies of the Obama Administration have taken hold, and

WHEREAS, North Carolina's gas tax already rose two cents per gallon under the automatic formula and is projected to raise another four cents a gallon on January 1, 2012 to 39 cents a gallon, which will make North Carolina's the second highest gas tax of any state in America, unless the Republican-controlled General Assembly acts before January 1, to stop the automatic increase, and

WHEREAS, some Republican House members filed House Bill 399 on March__, 2011 to cap the gas tax even before the first gas tax increase took effect on July 1, 2011, and

WHEREAS, House Bill 399 has not been allowed to come up for a vote or even get a committee hearing in the Republican controlled NC House, nor has the Republican-controlled NC Senate taken any action to stop the automatic gas tax increases, and


WHEREAS, in the past several yea[r]s, continuing up to the present time, the Democrats (1) have raided the state's Highway Fund to pay for their reckless spending on things other than roads and bridges, (2) have allowed waste, cronyism and even corruption to run rampant throughout state government but especially within the NCDOT, (3) have refused to allow any adjustment to the highway funding formula to dedicate current revenue from the gas tax to the most critically needed road and bridge projects, and (4) have instead, directed enormous sums of money toward lower-priority projects in the areas represented by their most powerful politicians or their contributors, and

WHEREAS, even on Wednesday, November 16, the Perdue administration told a legislative oversight committee that it intended to divert $5,000,000 of critically-needed highway funds to the Global Transpark,

WHEREAS, the unacceptable misuse, waste, cronyism and corruption in the area of transportation as set forth above has not yet been fixed - primarily because the current Democratic governor has not cooperated or provided any leadership in this effort, and

WHEREAS, the people of North Carolina are continuing to suffer in a down economy due to the counter-productive policies and actions of the Obama and the Perdue administrations, and tens of thousands remain unemployed or underemployed and simply cannot afford to pay more for a critically needed commodity every time they pull up to a gas pump to refuel, and


WHEREAS, the government of the state of North Carolina has no business asking economically struggling people to pony up more in gas taxes until it starts using the revenue from the already third highest gas tax in a much more responsible fashion, and


WHEREAS, we expect our Republican-led legislature live up to the promises of the last campaign and to take action to fix state government and be wise stewards of the taxes the state of North Carolina is taking from its hard-pressed people;

NOW, BE IT THEREFORE RESOLVED, that the North Carolina Republican Party, through its duly constituted and acting Executive Committee, do formally call upon the North Carolina General Assembly to act with alacrity to cap the gas tax in effect in the state of North Carolina to prevent another 11% increase in this tax from going into effect on January 1, 2012 and to take all actions possible to use the current revenue from the third-highest gas tax in the United States as efficiently and effectively as possible.

Washington,DC- Cold bitter winds blowing through Washington, DC today didn’t stop patriots from coming from as far away as Hawaii, Kentucky, South Carolina and Michigan to the Washington Monument to take stand for the American Constitution and the Declaration of Independence at the Restoring the Constitutional Republic 11.11.11 rally.


US Patriots Union founder, columnist JB Williams and Veterans Defenders of America leader Col. Harry Riley, who organized the rally knew in the planning stage that no matter how many the rally gathered, the snub of the mainstream media would be the same.


Along with JB, CFP columnists Navy SEAL Jim O’Neill and Dr. Ileana Johnson were there.

CFP editor Judi McLeod felt honoured to be asked by JB and Riley to address the gathering.

“Few eras in American and world history are more critical than the one we are all living right now.


“For this is the dark chapter when an undocumented ‘president’ works round-the-clock to deliver to global elitist power brokers his promised Fundamental Transformation of America.

“But as I stand right here with you at the cherished Washington Monument and see with my own eyes and hear with my own ears, your passion and unbridled patriotism, I take heart.

“For the presence of every single one of you here today tells not only me—but freedom and liberty lovers everywhere that American patriots will NEVER let the Obama-vowed Fundamental Transformation of America go down in history!!

The motto of my newspaper Canada Free Press states outright on its banner; ‘BECAUSE WITHOUT AMERICA THERE IS NO FREE WORLD” That’s the motto that should be on the New York Times the Washington Post and on all American newspapers who are in business only because of their readers and advertisers!

“BECAUSE WITHOUT AMERICA THERE IS NO FREE WORLD” should be the one chant shouted from every rooftop because it is the one chant that is the truth!

“The sun came up on a beautiful day at the Monument and CFP’s Brian Thompson, sussing out the site for Occupy Wall Street activists, said that the sun rising over the Washington Monument was an image that would live in his heart forever. And, like every other day just before sunrise, the Creator’s Orchestra of trilling, chirping birds warned of the dawn of another God’s day.

“The Occupy Wall Street crowd, incidentally, were still asleep in their tents or at home sleeping….They work in shifts and only appear mid-mornings.

“The sun, at least figuratively speaking, would not rise in Athens, Paris or Rome without America. America, no matter how politicians portray it, is the leader of the STILL-FREE West. America earned that place as world defender of democracy and it was paid for in the sacrifice of human life in wars whose ultimate goal was to keep the Free World Free.

“There would be no rising sun for many average little people raising families in far-flung corners of the world without America, whose ingenuity, courage and outstanding generosity have kept freedom alive in the West and abroad.

“All of us here know it has been a long three years, with an almost every Friday night shock thrown at the American people from politicians using the evil Marxist Saul Alinsky ‘Demoralize-the-Masses’ Rule Book.

“We all know that we are on the Last Mile and that the Last Mile—marked between right now and the November 6, 2012 Election will be the longest last mile of our lives.

“Think about it. Next Veterans Day, exactly one year from today will be AFTER the 2012 presidential election.

“Yesterday while driving through beautiful Pennsylvania to get here, I couldn’t get over the houses tucked in the deep valleys and up the majestic mountains, many likely there through long generations.

“Are these the ‘rich’ the Obama administration and their Occupy Wall Street friends squatting in the parks want to wipe out? Ordinary, industrious, hard-working Americans?

“That very memory of driving through Pennsylvania brings me to a specific message in my address to you today.

“For three years Barack Obama has travelled the world complaining about America and Americans. We know this to be true, but in order to win the fight against his fundamental transformation we must look into the reason why he constantly puts down an America that afforded he and his wife a life of privilege, including his election to the Oval Office.

“Obama needs to destroy American exceptionalism and to destroy forever the American ideal.

“The reason for that is Obama wants to hand America over to greedy and corrupt power brokers who see people as serfs—their serfs. In other words, Obama is doing nothing less than selling America out!

“No matter what happens on the Last Mile, those here today will look back to today. They will remember how the US Patriot Union and the Veteran Defenders of America told you here that today was not the end—but only the beginning of the battle ahead to Restore the Constitution and the American Declaration of Independence.

“It starts with the full confidence of knowing that Obama cannot take America—when Americans won’t give it away to him or any other politician.

“Everything is worth fighting for if there is to be any kind of legacy of freedom for our children and grandchildren.

“Obama and the power brokers whose employee he is never counted on the fire of patriotism imbued in the hearts of American patriots that has never died out since the day of the Founding Fathers…the day when men were statesmen and not career politicians. We the People never forgot it, only the politicians trying to cling to power did. But politicians like Barack Obama, Harry Reid and Nancy Pelosi are no different than other politicians, who like the leaves of autumn, are here today…and mercifully gone with the wind tomorrow.

“The things that matter most to a free people who come from a glorious history as Americans do are NEVER forgotten or let go.

“So besides saying God Bless America, God bless each and every one of you, I will end this the way I left the South East Michigan 9/12 Project when I spoke to them two years ago this June.

“As I was leaving the podium, I shouted out the one slogan heard and cheered by freedom lovers all over the world: That is: “USA!” “USA!”

“When Michiganian Cathy Tyler shouted my name followed by “USA!” “USA!”

“Cathy: Are you there?”

THE BLAZE: Will Occupy Wall Street Permanently Expand to Central Park This Friday?

Occupy Wall Street appears to be preparing for an Occupation expansion into New York City’s world-renowned Central Park.


This Friday– Veterans Day– the Occupiers plan to march to Central Park. The question at this point is, do they plan to stay and form a permanent, Zuccotti Park style Occupation?


There some indications the answer is “yes.”

There have been rumors for weeks that the Occupation would set up other franchises. Washington Square, Thompson Square, and Union Square parks have been reportedly under consideration, and some of those sites have already been playing host to nightly “General Assemblies.”

A permanent expansion of the Occupy Wall Street franchise would stretch police resources and exacerbate threats to public health and safety already seen in Zuccotti Park. So far, it hasn’t happened.

A Declaration to Restore the Constitutional Republic

“A CALL TO STAND!”—- Life, liberty and the pursuit of happiness should be the goal of every adult American citizen, not only for themselves, but for future generations.


That quest cannot become a reality unless each adult citizen possesses a patriotic mindset. The facts show that amassing self-serving political power and gaining wealth has displaced American patriotism among our government representatives, resulting in a deplorable lack of integrity and honor from our elected and appointed officials. Most Americans no longer trust their government.

Concerned American veterans and patriots, spurred to action by flawed and misguided interpretations of the Constitution, are determined to correct these ill-advised, if not traitorous, Constitutional perversions.

In accordance with The Constitution of the United States and the Declaration of Independence, they seek a peaceful solution to the tyranny facing We the People and the generations that follow.

It is apparent, based on many indisputable facts, that individual liberty, possession of property, national sovereignty, national security, and freedom will not survive if the present political power base prevails.

Therefore a course change is now required as determined by millions of Americans, and spelled out in “A Declaration to Restore the Constitutional Republic.”

The electorate voted for a President, not a tyrant. They do not want autocrats in any branch of government. Despots by their nature ignore constitutions and run roughshod over the laws of the land. Tyrants also over-regulate, and confiscate the citizen’s wealth; the people end up becoming economic slaves.

We The People are the back-bone of The Constitutional Republic of the United States of America. When 20 to 30 million citizens band together to petition for redress of “a long train of abuses and usurpations,” those grievances must be acted upon.

It must not be forgotten that all Legislative, Executive and Judicial powers are derived from the people. The restoration of the Constitutional Republic that we were entrusted with now begins by way of the “Declaration to Restore the Constitutional Republic,” and by We The People assembled, banded, and standing together as one unified citizenry.

Veterans and Patriots Call for Action in D.C. 11.11.11

On October 5, 2011, the following national call was released to the public - “An undisclosed number of American Veterans and former service members have come together to prepare and present this Call-to-Action on behalf of the U.S. Constitution, the Republic, the Rule of Law and equal justice for all freedom loving citizens of the United States of America. Acting together as one, via The Veteran Defenders of America, co-sponsored by civilian patriot group The Unites States Patriots Union, LLC – we issue the following CALL for peaceful disobedience.


We CALL upon every member of federal, state and local government, legislative, judicial, law enforcement and military, who have taken an oath to protect and defend the Constitutional Republic from all enemies, foreign and domestic, to act upon those oaths for the stated purpose of restoring the Constitutional Republic.

We CALL upon ALL veterans and veteran organizations in America, who still believe in their oath to protect and defend, to unite with us at once – in this Declaration to Restore the Constitutional Republic.

We CALL for ALL citizens who still desire freedom and liberty, to stand with us in peaceful protest, and carry our demands to right the wrongs against our nation in the preservation of freedom, liberty, justice and the rule of law.”

This National Call-to-Action for Veterans Day, November 11, 2011 in Washington D.C. is scheduled for 0600 EST at the Washington Monument.

The call is led by MG Paul Vallely, Col. James Harding and Col. Harry Riley of Veteran Defenders of America (VDA), a service member division of The United States Patriots Union. Both are member-only organizations formed and funded by an undisclosed number of members.

The Veterans organization focuses on matters of national security and defense of the US Constitution, freedom and liberty. Patriots Union is an advanced patriot group focused on tangible strategies for reclaiming the republic, ending corruption and tyranny in government and returning the power to the American people.

Together, they prepared and launched a nation-wide Call-to-Action to ALL freedom loving Americans willing to fight for their right to live free from government tyranny. But they also issued a Code of Conduct for their event in D.C. scheduled on 11.11.11…

The Call-to-Action has gone viral on the internet, thanks to vital coverage by conservative news outlets like World Net Daily, Canada Free Press and Post & Email. Veterans, patriots and groups have been joining the Call-to-Action since and it’s beginning to look like patriots across the country are finally ready to join forces for real solutions.

In any movement, there are two types of participants, active and passive. Over the last hundred years, as our constitution and nation was being systematically destroyed, only a relative few were active participants in the destruction.

But most Americans were indeed passive participants in that destruction, sitting silent as the destruction took place, thereby passively participating by default, via their inaction.

Today, a Call-to-Action has been issued that requires active participation from people who are passive by nature. The average American may be angry about what is happening in their country, but how many are truly ready to do whatever it might take to end the madness?

When asked who is supporting this Call-to-Action, VDA’s Col. Harding responded as follows – “Every red blooded American we reach is on board, except those who will never be on board.”

Harding went on to explain – “it is much easier to list who is not on board at this point.” – “leftists who have a very anti-American vision for America, people who have not yet accepted that there is no political solution now and those who have a seat at the table of corruption, are not on board.” – “Everyone else we reach is on board…”

The Code of Conduct clearly indicates that the group’s call is for peaceful resistance on 11.11.11. The likelihood that Obama & Co. will resign on request is zero. The odds that members of congress will do the right thing and impeach are also slim. So, what is the real goal of the 11.11.11 event?

Co-Founder of Patriots Union Timothy Harrington explains – “We have to start somewhere. We are hoping to show D.C. insiders that the people have had enough. That the time for talking has passed and the time for serious action to save this nation has arrived.”

“Every member of every branch of government has taken an oath to uphold and protect the constitution and the people of the United States and it’s high time we see which of them is ready to live up to that oath.” – said Harrington.

They like to refer to us as senior citizens, old fogies, geezers, and in some cases dinosaurs. Some of us are “baby boomer” getting ready to retire. Others have been retired for some time. We walk a little slower these days and our eyes and hearing are not what they once were. We have worked hard, raised our children, worshipped our God and grown old together. Yes, we are the ones some refer to as being over the hill and that is probably true.


But before writing us off completely, there are a few things that need to be taken into consideration. In school we studied English, history, math, and science which enabled us to lead America into the technological age. Most of us remember what outhouses were, many of us with firsthand experience. We remember the days of telephone party-lines, ten cent gasoline, and milk and ice being delivered to our homes. For those of you who don’t know what an icebox is, today they are electric and referred to as refrigerators. A few even remember when cars were started with a crank. Yes, we lived those days.

We are probably considered old fashioned and out-dated by many. But there are a few things you need to remember before completely writing us off. We won World War II and fought in Korea and Viet Nam. We can quote the pledge of allegiance, and know where to place our hand while doing so. We wore the uniform of our country with pride and lost many friends on the battlefield. We didn’t fight for the Socialist States of America, we fought for the “land of the free and home of the brave.” We wore different uniforms but carried the same flag. We know the words to the Star Spangle Banner, America, and America the Beautiful by heart, and you may even see some tears running down our cheeks as we sing. We have lived what many of you have only read about in history books and we feel no obligation to apologize to anyone for America.

Yes, we are old and slow these days but rest assured, we have at least one good fight left in us. We have loved this country, fought for it, and died for it, and now we are going to save it. It is our country and nobody is going to take it away from us. We took oaths to defend America against all enemies, foreign and domestic, and that is an oath we plan to keep. There are those who want to destroy this land we love but, like our founders, there is no way we are going to remain silent. It was the young people of this nation who elected Obama and the Democratic congress. You fell for the “Hope and change” which in reality was nothing but “Hype and lies.” You have tasted socialism and seen evil face to face, and have found you don’t like it after all.

You make a lot of noise but most are all too interested in their careers and “Climbing the social ladder” to be involved in such mundane things as patriotism and voting. It appears that we care more about our grandchildren than some care about their children. Many of those who fell for the “great lie” in 2008 are now having buyer’s remorse. With all the education we gave you, you didn’t have sense enough to see through the lies and instead drank the kool-aid. Now you’re paying the price and complaining about it. No jobs, lost mortgages, higher taxes, and less freedom. This is what you voted for and this is what you got. We entrusted you with the Torch of Liberty and you traded it for a paycheck and a fancy house.

Well, don’t worry youngsters, the Grey Haired Brigade is here, and in two months we are going to take back our nation. We may drive a little slower than you would like but we get where we’re going, and in November we’re going to the polls by the millions. This land does not belong to the Muslim in the White House or to Nancy Pelosi and Harry Reid. It belongs to We the People, and We the People plan to reclaim our land and our freedom. We hope this time you will do a better job of preserving it and passing it along to our grandchildren.

So the next time you have the chance to say the Pledge of Allegiance, stand up, put your hand over your heart, honor our country, and thank God for the old geezers of the Grey-Haired Brigade.
