The Nation: A State of Non-existence

Tuesday, January 7, 2014, Christian Mercenary

It is my opinion that there is no way to vote one's way out of the current political situation. I make this statement recognizing that there are those who will continue to seek a political (peaceful) solution to the current political situation until the very moment they are dispatched at the edge of a large pit filled with their neighbors and loved ones.

One must understand the political situation as it exists. There is no reverence for the Constitution, the only thing that decides who does and who does not wield the power and authority the citizens have placed in the government. There is a means by which to elect representatives, but representatives and senators who refuse to obey their oaths of office, who turn a blind eye to abuses of power and outright usurpation of their own powers can not be functioning as representatives or senators and therefore, whether duly elected or not, are traitors and subversives.

There are no separation of powers, no equality of governmental branches. There is a president acting wholly outside the Constitution, usurping and abusing power without limit or consequence. Once the Supreme Court signed off on Obamacare, it effectively ruled that whatever the government wishes shall be done. The decision, in that case, was so sloppy and contradictory that it demonstrated an absolute disregard for the rule of law, the Constitution, stare decisis and any number of other judicial instruments of justice.

The system is broken. It is no longer a system of government at all, but rather a system of power.

Vote "yes" on the Marriage Protection Amendment and convince everyone you can to do the same!!

Note:  We must urge everyone to come out and vote in the May Primary on this amendment!  Those opposing this protection for marriage will be out in full force and they are counting on voter laziness to defeat this amendment!
~Lynn

On May 8, 2012 NC voters will have the choice to amend the state constitution to read:
Marriage between one man and one woman is the only domestic legal union that shall be valid or recognized in this State. This section does not prohibit a private party from entering into contracts with another private party; nor does this section prohibit courts from adjudicating the rights of private parties pursuant to such contracts.

Opponents of the measure argue that the amendment is unnecessary because there is already a state law prohibiting same sex marriages and that the language of the amendment could be used to deny benefits to heterosexual families. But this marriage protection amendment law would prevent a judge from overturning the already existing ban on same sex marriage in North Carolina, as it has been done in MA, VT, NH, and other states.

I am amazed at the people who say they are voting against the marriage amendment because it doesn’t go far enough. That bothers me greatly. I do not understand why anyone would say they are voting against it because it doesn’t go far enough. This bill is a start! If it doesn’t go far enough, we can amend it later.

The institution of marriage is the heart of the whole reason for which God created us . God says the purpose of marriage is to preserve the human race, according to Genesis 9:1. “And God blessed Noah and his sons, and said unto them, Be fruitful, and multiply, and replenish the earth. He sent Noah and his wife, male and female, into the ark. He used similar wording regarding the animals in Gen.6:20: They are to reproduce after their kind. He made sure there was male and female of every kind, to preserve them.

Nearly two-thirds of likely North Carolina voters in the latest Civitas poll support the Marriage Protection Amendment that will be on the primary ballot on May 8, and support for the amendment increases among those who are opposed at the mention of a recent lawsuit challenging the state’s marriage laws.

Please vote “yes” to support the marriage protection amendment.

Federal Appeals Court Tells Voters Their Votes Don’t Matter Anymore

Federal Appeals Court Tells Voters Their Votes Don’t Matter Anymore

One of the most basic principles of freedom in America is the right to vote and to have your vote count. Thousands of lives have been lost and many more maimed to give us that freedom and to protect it. Millions of people in other nations would love to have the right to vote on matters that would affect their lives. To so many people worldwide, there is almost nothing more precious than the freedom to vote.

However, here in America, we are seeing a frightening trend where a court consisting of just one judge to as many as nine judges in the Supreme Court that take it upon themselves to tell American voters that their votes don’t count.

I recall a measure some years back where nearly 75% of voters in a southwestern state voted in favor of an English only bill. The bill was intended to save the state, county and city governments as well as employers thousands of dollars by not having to print everything in English and Spanish. It only took one liberal judge to declare the bill unconstitutional, thus telling the majority of the voters in that state that their votes didn’t matter.

There have been similar cases over the years and now we have another instance where the judicial system is telling Oklahoma voters that their votes don’t matter.

In 2010, 70% of Oklahoma voters voted in favor of State Question 755. SQ 755 was an amendment to the state constitution that barred courts from looking to the laws of other nations, especially Sharia laws when making their rulings in cases before them. The exact wording in the measure is, “Specifically, the courts shall not consider international law or Sharia law.”

Sponsor of the bill, State Senator Anthony Sykes explained that the goal of the measure was intended to restrict judges in Oklahoma to apply only US and state laws when they render their decisions. This also meant that judges were not to turn to any laws, including religious laws from other nations.

UPDATE ON VOTING MACHINE PROBLEMS IN NC

Voting Irregularities

The North Carolina Republican Party has been diligently investigating problems associated with voting machines, in particular iVotronic touch-screen voting machines in our state. These types of machines are in use in 35 of North Carolina’s 100 counties.

Reports began to surface last week of voter’s intentions not being properly registered by these machines. The specific incidents that first came to our attention were those who were attempting to cast a straight-ticket Republican vote but the machine was verifying that a straight-ticket Democratic vote had been registered. Fortunately, these initial voters were diligent in the verification process and after repeated attempts, called the problem to the attention of poll workers who assisted in making sure that the voter’s intentions were properly tallied.

Reports of similar problems began to come in from other parts of the state and at the time of this correspondence, (5pm October 28) we now have complaints from the counties New Hanover, Craven, Cumberland, Rutherford, Lenoir and Mecklenburg. I want to stress that there may indeed be similar issues in other counties using these same machines. To date, all documented voter issues involve attempts to cast votes for Republicans and at least one voter was a registered Democrat who was attempting to vote a straight-ticket Republican ballot.

Attorneys working on behalf of the NCGOP have been in contact with the State Board of Elections as early as last week in hopes of rectifying this issue and clarifying the causes of these problems. To date, it is our opinion that sufficient effort or progress has not been made by the State Board of Elections to ensure the integrity of the voting process.

For example, on Wednesday, October 27 the State Board of Elections conducted a informational session to instill voter confidence in Craven County, one of the first to report these problems. Concerned citizens came to hear information on the documented reports of machines engaging in what is known as “vote flipping”, registering for the opposite party or candidate than the voters intention. Instead they were given a remedial demonstration as to the operation of the touch-screen machine.

When one citizen expressed frustration about the lack of answers to the obvious concerns of the majority in the room, he was told by the State Board of Elections official that she was only there to demonstrate the machine and if he didn’t like that, he could leave.

Just today in Craven County, two republican poll workers were fired for talking to the media about the voting irregularities and what they claim was elections officials failure to properly address the issue.

Additional skepticism surrounds this situation due to the fact that the company responsible for the sale, distribution and maintenance of these machines has made headlines recently for questionable dealings in obtaining state contracts. Knowing that the ownership of the company in question, Printelect, has strong ties to the North Carolina Democratic Party and that the company itself holds a virtual monopoly on ballot printing and equipment maintenance for the state has only fueled suspicions.

This morning, NCGOP attorneys delivered a letter to the State Board of Elections demanding corrective action be taken immediately.
Appearing that the State Board of Elections has no intentions of taking corrective action, the NCGOP is contemplating proceeding to Federal Court on Friday to seek appropriate action to ensure the validity of the voting process in North Carolina. A total of 65 counties in our state use paper ballots tabulated by optical scanners; universally considered to be highly accurate and efficient. It is not equitable that those voters leave the polling place with a higher level of confidence that the votes have been accurately recorded than those using touch-screen machines.

Make no mistake; the NCGOP will not stand idly by and watch one of the most important rights we hold as Americans become subject to at best, a random game of electronic chance and at worst, an effort to subvert the political process.

This campaign is not about me. It's about WE.

A MESSAGE FROM NORMAN SANDERSON, CANDIDATE FOR NC HOUSE DISTRICT 3:

Vote as if your life depends upon it! It's true. I firmly believe that the life, liberty and pursuit of happiness that we have all enjoyed is at stake. As I have been out visiting with your friends and neighbors, we all agree on one thing: Our government on both a state and national level is OFF TRACK. We need a change in direction!

This campaign is not about me. It's about WE. It's about ensuring our personal freedoms, keeping more of our hard-earned money in our pockets, and holding government accountable in its spending practices. We need to keep first things first: economic recovery, improved education, properly funded military/fire/rescue/police departments. We need to allow the principles our great nation was founded upon to work without government take-over.

I have been personally attacked by my opposition who will stoop to any level to maintain political power. I hope you see through the political tactics and false promises and recognize that THERE IS A BETTER WAY.

If you have read something about me that concerns you, please feel free to call me directly at (252) 671-9610, and we will discuss your concerns.

You can still vote early through this Saturday at 1pm. If you are not registered to vote, you may do so at your early voting site and then vote - right on the spot. Please take your friends and family, and GO VOTE!

Registering Voters Long after the Deadline

G.K. Butterfield held an "Appreciation Rally" for himself on October 16, 2010 in Wilson, NC.

The deadline to register to vote was October 8, 2010. Why would his staff be registering people to vote on October 16th? I confirmed with Johnnie McClain at NC State Board of Elections that the ONLY WAY TO REGISTER TO VOTE after the deadline would be at a "One Stop Early Voting Location".

What do you suppose Butterfield's staff is going to do with those invalid registrations????

Chuck Norris

$200,000 for Capitol Hill Bottled Water?

The Congressional Budget Office just reported that in the past two years since President Barack Obama took office, federal spending is up 21.4 percent.

The national deficit was $1.29 trillion in 2010 (second to the $1.4 trillion in Obama's first year in office, 2009), which means that for every $1 the federal government spent this past year, it borrowed 37 cents of it!

The feds will tell you that their outrageous spending habits were necessary to pull our economy out of its recession. But would their same rationale justify the fact that the money Congress spends on itself has soared 89 percent over the past decade, more than three times the U.S. inflation rate?

It's true. In 2000, the feds spent $2.87 billion to run Capitol Hill. In fiscal year 2010, they almost doubled the amount, to an enormous $5.42 billion. From 2000-10, while inflation went up 26 percent, according to the Bureau of Labor Statistics, U.S. Capitol expenses went up 89 percent.

Were all those expenditures necessary to pull the economy out of a recession, too? Will the Obama administration again blame former President George W. Bush for its contemptible spending habits in its first two years?

According to Capitol News Connection and the congressional watchdog groups Sunlight Foundation and LegiStorm, here are just some of the itemized personnel costs of your legislative branch of government, including their comparative increases from 2000:

--Congress members' salaries and benefits: $126 million, up 23.5 percent.
--Expense allowances for Senate leaders: $180,000, up 99 percent.
--Senate officers: $178.98 million, up 99 percent.
--House leadership offices: $25.88 million, up 82 percent.
--Other House officers: $198.30 million, up 120 percent.
--Senators' personal offices: $422 million, up 75 percent.
--Representatives' personal offices: $660 million, up 62 percent.
--Architect of the Capitol salaries: $106.78 million, up 118 percent.
--Capitol Police salaries: $265.18 million, up 237 percent.
--Capitol Police general expenses: $63.13 million, up 860 percent.

Other items:

--Senate inquiries and investigations: $140.5 million, up 96 percent.
--Capitol grounds upkeep: $10.97 million, up 102 percent.
--Capitol building maintenance: $33.18 million (not listed separately in 2000).
--Senate office buildings: $74.39 million, up 16 percent.
--House office buildings: $100.46 million, up 169 percent.
--Capitol Visitor Center: $22.45 million (didn't exist in 2000).
--Congressional Budget Office: $45.16 million, up 72 percent.
--Government Accountability Office: $556.84 million, up 47 percent.
--Library of Congress: $446.15 million, up 73 percent.

--Congressional Research Service: $112.49 million, up 57 percent.

And if you don't think those costs are reflective of a nation in economic peril and government run amok, consider momentarily how critical these following costs are to running our country -- or are they?

--Since Democrat Nancy Pelosi took over the position of speaker of the House in January 2007, funding for her office soared 62 percent, from $2.9 million to $4.7 million. For a single office?!

--And taxpayers paid an enormous printing bill of $93.76 million, up 212 percent. (How many copies of the 1,000-plus-page Obamacare bill do you think that bought the feds? In a computer age of paperless transactions, don't you think they could save a few dollars here by learning what PDF files are?)

--According to the Sunlight Foundation, $4.28 million was spent on student loan repayments during the first quarter of this year as one of the congressional staff member employment perks.

--Pension costs continue to soar as congressional members enjoy the $60,000 annual benefit when they retire at age 62 after only having five years of congressional service. More than 400 former members receive average pensions of $60,000 a year.

--Taxpayers also forked out $3.27 million for Capitol Hill office supplies, as well as $628,332 for food. In addition, we spent $51.05 million on electricity and $4.63 million on sewer and water services in the Capitol building.

--And that water bill doesn't include the bottled water, which the House offices alone spent nearly $200,000 on during just the first quarter of 2010!

Friends, this next election fight is not for the weak at heart. Those elected next will either plummet our country into a fiscal abyss by maintaining the present course or deliver our economy from utter ruin by turning sharply to avoid economic disaster.

If our country is to survive, we must elect only those who show proof of fiscal discipline, refuse under all circumstances to increase our national deficit, disdain special interests, are willing to radically cut spending, and commit to pass and live under a constitutional amendment for a balanced budget. (Please join the movement to pressure Congress to do so, by signing BBA Now's petition for a Common Sense Balanced Budget Amendment. And for a voter guide detailing where candidates in your state stand on issues, go to http://www.christianvoterguide.com/.)

With the present elective battle at hand, I call upon the great battalion of patriots to get out and vote Nov. 2 in the same spirit in which George Washington admonished his army in 1776: "The hour is fast approaching, on which the Honor and Success of this army, and the safety of our bleeding Country depend. Remember officers and Soldiers, that you are Freemen, fighting for the blessings of Liberty -- that slavery will be your portion, and that of your posterity, if you do not acquit yourselves like men."

(I also encourage everyone to check out the trailers to two new patriotic films playing near you, "I Want Your Money" and "Battle for America.")

News : Congressional race pits Butterfield against Woolard (Roanoke Rapids, NC)

While Buttefield attended a "forum" Friday where no challenger was present--he refused the opportunity to debate Mr. Woolard in Havelock, NC on Friday evening.  Guess he looks better with out competition.

Butterfield has voted with Nancy Pelosi 97% of the time.  Is there really any doubt who to vote for?

NC FREEDOM

Be aware, Constitutional amendment on Nov. 2 ballot

By Sybil Stafford

On the Nov. 2 ballot in NC is a referendum for a “Constitutional amendment providing that no person convicted of a felony may serve as Sheriff.” For or Against? The actual law will read “No person is eligible to serve as Sheriff if that person has been convicted of a felony against this State, the United States, or another state, whether or not that person has been restored to the rights of citizenship in the manner prescribed by law. Convicted of a felony includes the entry of a plea of guilty: a verdict or finding of guilt by a judge, magistrate, or other adjudicating body, tribunal, or official, either civilian or military: or a plea of no contest, nolo contendere, or the equivalent.” The bill was sponsored by Rep. Sutton of District 47 and ratified July 1, 2010.

At first this seems like a good idea but after much thought I decided that it is a dreadful idea.

First: It is our civic duty to vet who we are voting for, preferably before the primary so we have the best person running for the office.

Second: We live in a country that is passing so many laws it is almost impossible to not break a law in normal daily life. Example: When you are born in this country if you do nothing you have broken a law because you have not bought health insurance.

Third: In Arizona Sheriff Arpaio is being investigated and sued by the federal government for enforcing the illegal immigration laws. He is a good sheriff that the government is trying to destroy.

Fourth: I believe there could be a situation where a corrupt sheriff would set up a good person whom he believed is going to run against him. Have him arrested and convicted by his cronies. And as mentioned in my third reason it could be any other branch of local, state or federal government.

Fifth: People have run for sheriff that are felons before and they were not elected. County governments are small areas where it is easy to find out about the people running, and the opponent will absolutely let everyone know that the person running against him is felon. The system works, we do not need a Constitutional Amendment to fix what is not broke.

Matthew Lyon served in the Fifth and Sixth Congresses of the United States (March 4,1797 – March 3, 1801). In 1798 he was found guilty of violating the Alien and Sedition Acts. His violation was he had criticized President John Adams. He was sentenced to four months in jail and a $1000 fine. While in jail he was elected to the Sixth Congress and his constituency paid his fine. In 1800 he cast the deciding vote for Thomas Jefferson for President when the election went before the House of Representatives because of an electoral tie.

We are not Homer Simpson! We can think for ourselves! We must keep the option to decide this matter for ourselves. The system has not failed us so why change it?

This amendment should be debated. People should not go blindly to the polls and vote without thinking about this.

Townhall Columnist: Terry Paulson

Election Choices Matter

Mon, Sep, 27, 2010

Clarity on the facts and issues that matter to America’s future should be important to every informed voter. This time of dramatic change is ushering in a real choice in the November election. As you’ve noticed, “We the People” are creating havoc in the establishment of both parties. Candidates are surfacing who promise to do more than talk principles; they promise to govern that way. That gives American voters important choices.

Choice #1: Bigger Government or More Empowered Individuals. Do you want big government determining which special interests are rewarded and which companies are “too big to fail,” or do you want limited government where all people can pursue their dreams, succeed, fail and take personal responsibility for inventing their own future? America was built on individual responsibility, caring communities, and free-enterprise opportunity where you earned your own success. The current administration is trying to spend and regulate its way into a recovery and job growth. Since President Obama’s first month in office, the number of private-sector jobs has decreased by nearly 2.7 million, and the number of federal government workers has increased by 379,000. A recent audit revealed that the $111 million of stimulus funds invested by Los Angeles created 55 jobs at a cost to taxpayers of $2 million per job. Big government is so out of control you can watch our deficit explode. It’s the private sector, not big government, that is the economic engine for recovery. With 44 million Americans now in poverty, have you had enough of bigger government?

Choice #2: Government Entitlements or Individual Responsibility and Charity. Government entitlements are relatively new in America, not existing before 1929. If somebody fell on tough times, family, friends, and neighbors helped. Now, sixty percent of Americans get more in public services than they pay in taxes. That isn’t charity; that is government taking money from some citizens by force of law through taxation to provide benefits to other citizens. Since 1929, entitlement benefits have exploded: Social Security (1929), National School Lunch (1946), Medicaid/Medicare (1965), Food Stamps (1974), Home Energy Assistance (1981), Medicare Prescription Drug Plan (2003), Healthcare Plan (2010). No entitlement has cost less than projected. When government makes promises it can’t afford, it either increases taxes, prints more money funded by debt paid by future generations, or drastically cuts promised services. A government creating dependent citizens is no more caring than parents spoiling dependent teenagers. Such programs leave future generations buried under the weight of our government largesse. Entitlements account for more than half of federal spending, and unfunded liabilities, the obligations not covered by payroll taxes, exceed $100 trillion. Are we ready to stop digging the hole deeper?

Choice #3: Punish Success or Incentivize the American Dream. Do you believe that incentives matter? Have you noticed that so-called “rich people who don’t pay their fair share” are being repeatedly tapped to pay the bill? Many economists are saying that the economy is poised to take off, but the private sector is lagging. It’s small business growth that has always fueled economic recoveries and job creation, but why should “the rich” risk capital? Instead of rewarding such risk, the current administration is adding burdensome regulations, increasing taxes on their income, and making it hard for them to survive in today’s competitive global economy. Liberals claim that “the rich” do not pay their fair share of taxes. That is a convenient myth used to justify envy and income redistribution. The richest 5% of our citizens pay 60% of the total federal income tax bill. If you agree that these citizens are not paying their “fair share,” try paying their share and see how it feels.

Choice #4: “The Gingrich Boom” or “The Pelosi Collapse.” Mid-term elections matter. People talk about the “Clinton Boom” and the “Bush Collapse,” but Michael Medved points out that it’s more accurate to contrast two mid-term “triumphs” that strongly impacted the American economy. In “The Gingrich Boom,” ushered in by the 1994 conservative takeover of both houses of Congress, average unemployment went from 6.5% to an average of 4.77%. The federal deficit average went from 3.35% of GDP to an average of less than zero with surpluses from 1998 to 2001. With “The Pelosi Collapse” initiated with the Democratic takeover in 2006, average unemployment went from 5.29% to an average of 6.57%. It’s now 9.6%. Sadly, the federal deficit average went from 1.91% of GDP to 4.74% in the next two years. Now the deficit spending has reached 10.27%.

Had enough? Ready for a change? The choice voters made in 1994 made a difference. Be an informed voter and make your vote count this November.

Letters to the Editor - Sun Journal, New Bern

Liberals in NC

September 11, 2010 11:03 PM

Is North Carolina more liberal than California? It seems so at times. California voted over 10 years ago on marriage between a man and woman by over 60 percent. Has N.C. even been allowed to vote on the issue? Has the legislature even wanted to protect traditional marriage? I haven’t seen it.

Jessica’s law was passed in California years before North Carolina. At a “town hall” meeting at Havelock library when I asked Rep. Wainwright about Jessica’s law, he asked, “What is that?” For a legislator not to know what that law is shows something is wrong. Uninformed? Or what is the problem? When I asked him after a Havelock Chamber of Commerce meeting about drilling for oil, he said, “We have to protect the trees.” I think people are more important than trees. I also asked him if he realized that his pro-abortion stance may have helped kill the future scientist who could have found a cure for cancer and he walked away. He should walk away from his job and let Mark Griffith help our state.

Going to Village Butcher a couple of years ago Alice Underhill was leaving it and commented on my bumper sticker. It reads “Drill for American oil now.” She came up to my car and said, “That’s not possible.” I asked, “Why not?” “It would take 10 years to drill if we found any.” “That’s what Bill Clinton said 10 years ago,” I reminded her.

“They don’t think there is much oil off North Carolina,” she said and I wanted to ask, “‘Who are they?’” as she rushed off. I think she needs to rush away from the law-making body also. Norm Sanderson’s business experience is actually better preparation than school teaching for representing us. In my opinion he legally won last time. Everyone should support him this time and keep an eye on the ballots.

Also, the UNC Board of Governors appointed Wake Forest University President Thomas Ross as the 17th president of the UNC system. Civitas reveals several questionable marks on Ross’ record, including over $200,000 given to ACORN. Do you want ACORN to control ballot returns?

If you love high taxes and big spending on plane rides, vote for liberals. If you think we deserve to keep more of the money we earn, vote for conservatives. (Don’t forget what caused the USSR to fall; the second S, socialists.)

SUN JOURNAL-NEW BERN, NC

Tea Party scheduled for Saturday in Havelock

HAVELOCK — The Coastal Carolina Taxpayers Association has scheduled a Labor Day weekend Tea Party from 4 to 8 p.m. Saturday at the Havelock City Park.
http://www.newbernsj.com/news/havelock-90317-party-saturday.html

According to organizer Lynn Childs, the event will focus on taxes, jobs and the economy as well as immigration, amnesty and voting responsibility.

The Rev. Walter Leake, a former chairman of the Craven County Republican Party who has been involved with the Christian Coalition, is scheduled to be the guest speaker.

"He is a man who loves God and country, and he’s very loved in the area," Childs said.

Another speaker will be Jose (Joe) Dominguez.
"He immigrated to the country when he was 14 with his family, and he will talk about what the process of gaining citizenship meant to him and what his country means to him," Childs said.

Other speakers scheduled include Jeff Lewis, of the N.C. Fire Coalition, and Melvin Cooper, from the U.S. 70 corridor project. There will also be speakers from Freedom Works, the John Locke Foundation and the Civitas Institute.

Childs said there would be an open microphone period for attendees who want to speak.

Music will be provided by the "Metz Girls."

Those attending are encouraged to bring friends, lawn chairs and signs if they desire.

Childs said she hopes people will be encouraged to come out after the huge turnout in Washington last week for Glenn Beck’s Restoring Honor rally.

"I was there," Childs said. "It was the most moving experience I have ever had in my life. This was about bringing people back to God, and revitalizing and looking for the merit in each of us."

The Coastal Carolina Taxpayers Association is the former Craven County Taxpayers Association, with its reach extending to Carteret, Pamlico and Jones counties as well.

"Things heated up with the way America was moving, and we became the voice of the Tea Party movement," Childs said.

In the event of inclement weather, Saturday’s event will be rescheduled.

Daren Bakst

RALEIGH — North Carolina legislators left Raleigh this year without expanding the state’s system of taxpayer-financed election campaigns. But advocates pushed for expansion, and they’re likely to push the idea again in 2011. Before lawmakers left town, Daren Bakst, John Locke Foundation Director of Legal and Regulatory Studies, discussed the problems associated with so-called “public financing” of campaigns during an interview with Donna Martinez for Carolina Journal Radio. (Click here to find a station near you or to learn about the weekly CJ Radio podcast.)

Martinez: This just doesn’t sound right. Let me make sure I understand this. Would this mean that, for example, a progressive, a liberal person, would end up having to help fund the election campaign of a fiscal conservative?

Bakst: Yes. They’d have no choice but to be funding those campaigns.

Martinez: How does this work? What’s written into this bill?

Bakst: Well, what it does is it gives some local governments the option of using public financing, i.e., taxpayer financing, to subsidize candidates for office. So basically these candidates get a lump sum amount of taxpayer dollars to run their campaigns. You don’t have a choice about whether or not that taxpayer money, your taxpayer money, is going to candidates you oppose or people who support ideas that you find reprehensible.

Martinez: What would happen if, let’s say, that I’m a taxpayer and I’ve decided for whatever reason that I’m just not interested in politics? I’m not even going to vote.

Bakst: Well, you decide you don’t want to pay taxes, but that wouldn’t be a good idea, so you have no choice.

Martinez: Well, supporters say this would move us toward something they describe as a “clean election system.” They say this will help fend off corruption so that people don’t have to go out and raise a bunch of money on their own. Valid? Or not?

Bakst: Well, the problem is, first of all I want to clear up [that] this entire system is almost certainly unconstitutional. And I won’t get into the constitutional analysis, but two federal District Courts recently have struck down these types of taxpayer financing systems, and I think certainly this would be found unconstitutional.

Martinez: What is the basis — for those of us who aren’t attorneys — the basis for striking that down?

Bakst: Well, the way it works is that the systems try to equalize the funding between candidates. So, if Candidate A, who is not taking taxpayer dollars, spends, say, $100,000, and they set a threshold limit of $95,000, and if you spend beyond $95,000, any additional amount beyond that goes to the opponent. So if I spent $5,000 above a threshold amount, the candidate that takes the taxpayer dollars gets $5,000 to equalize the funding between the candidates.

But as a result, if I’m the candidate who knows that I’m going to give $5,000 to my opponent, what am I going to do? Well, I’m not going to engage in speech. And what it does is, that is exactly what happens. It chills free speech because you don’t want to engage in speech if you’re going to help your opponent. And that’s why, primarily, they are being struck down.

Martinez: There are some candidates, and I have read about them and heard about them, who really like this idea of publicly financed campaigns. They don’t want to go out and raise money. But raising money, the folks on the other side say, is part of the whole process of vetting the ideas in the marketplace.

Bakst: Well, when you say the other side, I think you mean my side.

Martinez: Exactly.

Bakst: Right, absolutely. You know this idea that fundraising is somehow evil or is bad, well, fundraising is an essential part of the political process. That is how we determine whether or not somebody is a legitimate candidate. That is part of the process. Of course a lot of candidates don’t want to raise money. Why should they have to try to actually get support when they can take your taxpayer dollars and, you know, they can sit around and drink pina coladas.

Martinez: Interesting. You know over in Chapel Hill in Orange County, they actually had a pilot program with public financing of local election campaigns. This took place last fall. There’s been some interesting reaction to how that worked. What’s your take on what happened in Chapel Hill?

Bakst: You know, proponents of taxpayer financing can’t get their stories right. On the state level, they argue, “Oh, see the program works because so many people participate in taxpayer financing programs.” Well, of course people participate because if you’re going to punish a candidate for not participating so severely, you have no choice but to participate.

But then in Chapel Hill, what happened was only a couple of candidates participated, and most of the candidates didn’t participate. So it was kind of tricky for them. “We can’t argue that a lot of candidates participated.” What they did was to show that the candidate that did participate won. Well, that doesn’t show that the system works because a candidate won. … It doesn’t do anything as it relates to taxpayer financing. As for politicians, of course they love it, also not only because they get to sit around and hang out and listen to Jimmy Buffett and drink pina coladas, they…

Martinez: Who wouldn’t want that?

Bakst: Right. Who wouldn’t want to do that? You know, what’s important is, if they’re incumbents, it helps them because if you have equalized funding between candidates, incumbents are always going to benefit because they have better name recognition. So the only way for the challenger to overcome that advantage is to spend more money.

And the idea that more money somehow is bad for the system is incorrect. We need money to kind of get the message out there. It’s not just spending money; it’s about getting the message out. People become more informed about the campaigns, not to mention these systems only deal with direct contributions to these campaigns. It doesn’t deal with independent expenditures or other types of spending. So it’s not decreasing the total amount of spending in these campaigns — only one type of spending, basically.

Martinez: This issue of public financing of campaigns at the local level is one that’s probably going to be coming up. So if I’m a citizen out in the community and I know that my local government entity is talking about this, what questions should I be prodding them to ask as they consider this?

Bakst: Mr. Politician, Mrs. Politician, do you believe in political welfare? Do you believe that you should be taking our hard-earned dollars away from critical issues such as safety — if it was on the county level, from schools, maybe roads — and instead giving it to you for your personal benefit so that you can run your campaign so you don’t actually have to get out and actually raise money on your own? Is that really what you think our tax dollars are for — for your benefit? That would be one good question. Also, do you respect the United States Constitution? Because almost certainly, these systems are unconstitutional.

Martinez: What we’re talking about is doing this at the local level, but North Carolina does engage in public financing of campaigns a couple of different ways. Tell us what they are. One is judicial races.

Bakst: Judicial races — appellate judicial races — and also three Council of State races, which means the Commissioner of Insurance and a couple of other positions.

Martinez: There is somewhat of a push, by some folks at least, to fund more Council of State campaigns this way.

Bakst: Absolutely. I mean, look, the goal for people that support clean elections is to have clean elections for every race. What’s interesting is that the State of Arizona, where clean elections kind of started — one of the states — there’s tons of corruption. Because what happens is people game the system and they will figure out ways to trigger these kind of funds that I was talking about — these matching funds — to the candidate. So I’ll run an ad that actually hurts a particular candidate as opposed to helping and gives the impression that it is helping. Then it triggers money to the other candidate that I actually support. So there’s lots of gamesmanship. There’s lots of corruption in those systems as well. So it’s not getting rid of corruption.

Money isn’t bad in the system. There are many other alternatives. And also, we need to do things that are actually consistent with the Constitution. The other thing — final point — taxpayers simply don’t support these systems. On the tax returns in the state, you … can check off a little box. Only about 7 percent or 8 percent of taxpayers have checked off that box to support public financing

Nowicki: Jim Deakin may play spoiler in GOP Senate race

by Dan Nowicki, columnist - Jul. 18, 2010 12:00 AM

The Arizona Republic

Supporters of Hayworth, a former Arizona congressman and radio talk-show host, have long clamored for Deakin to step aside so as not to split the anti-McCain vote. On Thursday,William Gheen, president of the national group Americans for Legal Immigration Political Action Committee, or ALIPAC, stepped up the pressure, publicly calling on Deakin to drop out or else risk becoming known as the "political spoiler" who helped McCain win the Aug. 24 primary. ALIPAC, which opposes illegal immigration, has endorsed Hayworth and donated money to his campaign.  (Read more)
