The New Bern Housing Authority Board of Commissioners filed suit against New Bern Mayor Lee Bettis Tuesday.
It seeks to keep him from firing them by getting a temporary restraining order from a superior court judge on Thursday.
Bettis has threatened to remove the commissioners from office after a hearing he scheduled for 3:30 p.m. Friday and will not postpone.
One authority commissioner is out of town on a previously planned trip and will not be back in time for a hearing and another has a medical procedure scheduled.
A cover letter signed by Authority Chairwoman Ethel Sampson advising the New Bern Board of Alderman of the suit, said, “The board has suffered through his false accusations, intimidating behavior and erratic demands for long enough.
